W1.11v11J1. ••VVJ..ri. - L1111111 1•1{rJJG46V
Exhibit 3 - Correspondence with DRMS Staff Indicating Ski Lake is
Adequately Reclaimed
From: "Crosby, Erica" <Erica.Crosby @state.co.us>
Carl,
It does not appear that the ski -lake area of the Baseline Resources Pit (M -1997 -058) has
been released for reclamation responsibility at this time even though my report indicates
that the site is adequately reclaimed. In order for this portion of the site to be released,
Hall -Irwin will need to request a partial bond release for the ski lake area in writing. When
the release request is received by the Division, the Division will inspect the site and
determine if it is adequate for release (within 60 -days of the request unless a weather
delay is needed). You should talk to Hall -Irwin about submitting a partial release request
for this area.
Let me know if I can be of further assistance.
Erica S. Crosby
Environmental Protection Specialist
Division of Reclamation, Mining & Safety
1313 Sherman St. Rm. 215
Denver, CO 80203
303 - 866 -4943
From: Carl Eiberger [mailto:bladc.bear@comcast.net]
Sent: Sunday, January 06, 2008 10:07 PM
To: Crosby, Erica
Subject: DRMS, M- 1987 -058, Ski Lake & Fish Habitat Release
Erica,
We spoke on Friday about the Baseline Resource Operation, M- 1987 -058, located
in Weld County.
I was able to review additional information and an annual report which I have
attached. The northern portion of the mining operation is located on the
Baurer's and my property. The ski lake was mined 10 years ago and the adjacent
Stillwater Reservoir, which the City of Aurora will be storing water in, is being
reclaimed at this time.
The annual report which I have attached has an inspection date of
2/24/2006. Page 5 of the report includes " "The Ski Lake" pit has been completely
mined and reclaimed. The pit is not lined and the source of the lake water is
groundwater. The reclaimed pit is used as a private water ski lake by the
landowner. According to the operator, pit slopes were graded 8H:1 V to reduce
the rebound wave action caused by the boat. Vegetation on the site is well
established and appears to be free of noxious and annual weeds."
Would you let me know if the ski lake been released by the DRMS?
If you have any questions feel free to contact me at 303 880 -4001 and
black.bear: @comcast.net.
Attached: DRMS (DMG) Hall Irwin Annual Report DMG, February 23, 2006, 6
Pages.pdf
Thank you for your time.
rzgC . 01 .1
http: / /mailcenter.comcast. net/ wmc /v/wm/4785D98E000B5FA300002AB 122069997359D... 1/10/2008
