On June 3, 2011 the New Elk Coal Company responded to an adequacy response (April <br />13, 2011) which included a direct response to CDOW's concerns. <br />CDOW's comments from this point pertain specifically to the May 2011 Plan: <br />4.1.2 Gas Well Monitoring Plan — 7 bullet: Insert "and / or gas well" so that this <br />reads "Structural anomalies reported by the surface and / or gas well owner(s) will be <br />investigated." <br />4.2.2 G as Pipeline Monitoring Plan — 4th bullet: Insert . "and /_ or gas well" so that this <br />reads "Structural anomalies reported by the surface and / or gas well owner(s) will be <br />investigated" <br />4.2.4 Gas Pipeline Damage Mitigation Plan — 1 st bullet: Insert "and surface owners" <br />so that this reads "Appropriate personnel at mine and regulatory authorities, as well as <br />the owners of the pipeline and surface owners, should be informed " <br />The January 2011 Plan (3.2 Gas Pipelines) recommended that pipelines should be <br />decoupledfrom the surrounding ground. CDOW was pleased to note that this language <br />has been stricken in the May 2011 Plan (4.3 Gas Pipelines) with the recommendation <br />that retreat mining buffer zones developed around the pipeline network should be <br />adequate to protect these structures from damage. <br />On June 30, 2011 the CDOW hosted a meeting at its Denver offices attended by <br />representatives of Cline Mining, New Elk Coal Company, Agapito Associates, XTO <br />Energy and the Colorado Oil and Gas Conservation Commission, Division of <br />Reclamation, Mining and Safety and CDOW. The purpose of the meeting was to create a <br />communication link between agencies and private businesses, coordinate the energy <br />extraction efforts by New Elk and XTO, and review the Subsidence, Control, Monitoring <br />and Mitigation Plan for the coal mine <br />Subsequent to this XTO and New Elk have agreed to meet again to provide comments to <br />this adequacy review. Because the CDOW's long -term management goal is no net loss <br />of surface function for wildlife, we respectfully request that we be allowed to review any <br />additional recommendations they develop that might affect the surface character of the <br />Bosque del Oso State Wildlife Area. <br />STATE OF COLORADO • COLORADO STATE PARKS <br />John W.
