Mike Boulay <br />Rule 2.04.4 Cultural and Historic Resource Information <br />Rule 2.04.6 Geology Description <br />6. Division Response: Response accepted. <br />-4- July 8, 2011 <br />4a. The first paragraph of Section 2.04.3(1) says private lands are under <br />jurisdictions of Mesa County and City of Fruita. On Map 02 Surface <br />Ownership, please show limits of the City's jurisdiction. <br />CAM - Map -02 has been revised to show jurisdiction of City of Fruita. Since submitting <br />Adequacy response #2 it was determined that City of Fruita claims ownership of <br />CR -15 south of SH 6 & 50. Therefore, Mesa County was removed from Map -02, <br />and page 2.03 -4 was revised. <br />5. Please refer to the enclosed comment letter from the Colorado Historic Society <br />(CHS) dated October 21, 2010 provided in Attachment 1. Following their review of <br />the Class III Cultural Resource Inventory report and additional documentation <br />provided to them by Grand River Institute they concur that a finding of no historic <br />properties affected is appropriate for the proposed project. Please note the <br />following as indicated in the CHS letter. Should unidentified archaeological <br />resources be discovered in the course of the project, work must be interrupted until <br />the resources have been evaluated in terms of the National Register of Historic <br />Places eligibility criteria (36 CFR 60.4) in consultation with their office. No further <br />response from CAM is necessary at this time. <br />CAM Response: CAM has received the letter from CHS and reiterated that no <br />action from CAM is necessary at this time. <br />Division Response: With the April 11, 2011 response submittal CAM is proposing <br />a new 10.5 acre construction material borrow area located within the southern end <br />of the permit boundary area. This area was not included in the May 2010 Cultural <br />Resource Inventory that was submitted with the original permit application as <br />Exhibit 2. Rule 2.04.4(1) requires that all areas proposed or likely to be affected by <br />surface activities be included in the assessment of cultural resources. Please <br />update or otherwise amend the Cultural Resource Inventory prepared for the <br />Fruita Loadout to include the new borrow area that was recently <br />incorporated into the proposed permit boundary. <br />CAM - Enclosed is a Class III cultural resources inventory of the new borrow area to be <br />inserted in Volume I, Exhibit 2. A description of the cultural resources inventory <br />was added to page 2.04 -5 and 2.05 -69. <br />
