On page 2.05 -43, CAM states that the applicant is in the process of obtaining <br />Mesa County approval of the project. Please expand upon this and describe <br />the type of permit that is being sought and also list this information in <br />Section 2.03.10. <br />CAM - Please see revised page 2.05 -43 and page 2.03 -11. <br />Rule 2.05.6(1) Air Pollution Control Plan <br />84. Division Response: Response accepted. <br />Rule 2.05.6(2) Fish and Wildlife Plan <br />85. In Subsection (2)(a)(i), the applicant commits to using best management practices <br />for watershed protection during construction activities. Presumably, those <br />activities would relate to the installation of both short term and long term drainage <br />and sediment control, and soil stabilization measures, in both the primary facilities <br />area and along roads and the rail spur. Please summarize the practices that will <br />be employed, and reference the relevant application sections where such practices <br />are addressed in more detail. In the same subsection, water depletions and <br />associated measures are referenced. A sentence fragment related to the water <br />depletion discussion is missing, between the bottom of page 2.05 -43 and top of <br />page 2.05 -44. Please restore the missing sentence fragment. After sedimentation <br />control plan is developed for the rail this can be better addressed. <br />CAM Response: Please see revised page 2.05 -43 for discussion of short term <br />sediment control. The long term sedimentation control plan is discussed in various <br />parts of section 2.05.3(4). The sentence fragment has been corrected on page <br />2.05 -44. <br />Division Response: The applicant committed to using best management practices <br />to protect the watershed, including the batch weigh system for loading rail cars <br />minimizing coal spillage into Reed Wash and the use of silt fences and /or straw <br />bales during construction of the rail bridge.
