Exhibit M — Other Permits and Licenses <br />Paul Banks and Associates, LLC <br />County Land Use Permit <br />Special Use Permit No. 2004 -004 was approved and issued by Pueblo County on March <br />23, 2004. <br />County Flood Hazard Area Development Permit <br />A Pueblo County Flood Hazard Area Development Permit was approved on May 10, <br />2004. <br />CDPS State Discharge Permit/Stormwater Permit <br />Colorado Discharge Permit No. COG - 500000 for Facility Number COG - 500453 was <br />issued on June 23, 2008 and will expire on June 30, 2013. In addition, the applicant has <br />created and executed a Stormwater Management Plan in accordance with the discharge <br />permit. <br />Air Permits <br />Final Approval of Air Permit No. 04PB0262F was granted on April 18, 2006, by the <br />Colorado Department of Public Health and Environment -Air Pollution Control Division. <br />Then following activities are subject to the air permit limitations: aggregate extraction, <br />handling, stockpiling and hauling. This permit was renewed on November 16, 2009 and <br />the next renewal will be due on October 16, 2014. <br />Road Access and Maintenance Agreements <br />On September 13, 2005, the Pueblo Board of County Commissioners accepted the <br />required road improvements to Nyberg Road as part of the Pueblo County Highway <br />System and for maintenance purposes via Resolution No. 05 -233. <br />On October 14, 2005, the applicant received an approval letter from Todd Ausbun, <br />CDOT Region II Access Inspector. Specifically, the access improvements on the south <br />side of State Highway 50B at, approximately, milepost 327.40 at Nyberg Road was <br />inspected and deemed sufficiently installed in accordance with the terms and conditions <br />listed in Access Permit No. 204038. <br />Gravel Pit Well Permit/Substitute Water Supply Plan /Replacement Water Lease <br />Gravel Pit Well Permit No. 62251 -F was issued on February 14, 2005 for aggregate <br />production and dust suppression. Specifically, this permit allows an annual groundwater <br />appropriation of 44.67 acre -feet and a pond with a total surface area of 9.76 acres. The <br />use of groundwater, in addition to evaporation, is limited to dust suppression and water <br />lost in product. This well is operated in accordance with the St. Barbara Sand and Gravel <br />Pit Substitute Water Supply Plan approved by the State Engineer on December 3, 2004 <br />and subsequently renewed on May 20, 2011 (effective January 1, 2011- December 31, <br />2012. The source of replacement water for the Plan is via a 10 -year lease with the <br />Pueblo Board of Water Works, which was initially executed on April 13, 2004 and <br />subsequently renewed on November 5, 2010. <br />State Historic Preservation Office <br />The Colorado Historical Society (CHS) records indicate that no historic and cultural sites <br />and no surveys were located on the property.
