Dear Mr. Janes,
The Division has identified several other comments and questions that must be addressed prior to
the Division's decision due date.
6.4.12 Exhibit L — Reclamation Costs
1. The Applicant has proposed using the same unit rates that were used in the Kurtz Resource
Recovery & Land Development Project (M- 1999 -006) to determine the cost to dewater the
pits at the Western Sugar Reclamation Land Development Project. The pumping rates for the
Kurtz site were approved because the Operator was able to demonstrate that a pump and
associated infrastructure was in place at the site. In addition, the Operator supplied data
demonstrating the cost to operate the pump. Please confirm the same pump and associated
infrastructure will be installed at this site. Also, please confirm the cost to operate the pump
will be the same as the cost at the Kurtz site.
6.5 Geotechnical Stability Exhibit
2. The Division has reviewed the Applicant's response to the Division's Slope Stability
Analysis dated June 11, 2011. Please respond the Division's comments in the attached
document and make any necessary changes to the applicable exhibits.
As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies
prior to July 16, 2011, it will be your responsibility to request an extension of time to allow
for continued review of this application. If there are still unresolved issues when the decision
date arrives and no extension has been requested, the application will be denied.
