Exhibit D- Extraction Plan <br />Summary Status of Affected and Unaffected land as of this is detailed further under <br />Exhibit E — Reclamation Plan and Exhibit L — Reclamation Costs; and attending maps. <br />Extraction of planned basins and lining of basins is complete as determined under a <br />previous 2010 Technical Revision and attending correspondence. <br />As part of the excavation activity, nearly 5.0± acres remain open with exposed surface <br />waters and needing fill (refer to Exhibit D — Extraction Plan and Exhibit E — Reclamation <br />Plan). Since there are adequate water resources to account for the exposed surface <br />waters over the 5.0± acres pending fill, if fill activity stopped, at this point or when the <br />acreage is less, since this is an area designated for post permit agricultural stockpiles <br />and equipment storage, no additional expenses for resoiling or revegetation for this <br />area are necessary. The activity extends the extraction /excavation out an additional <br />five years, with finished revegetation of the surrounding vegetation strip an additional <br />five years, with an estimated end date of 2021. <br />Area 1 fill is complete and Area 3 011 is predominantly needed within a portion of 3 (A) <br />and (B): Estimating nearly half of Area 3 (A) is filled with little to no exposed <br />groundwater; nearly 3.3± acres will require an additional top of 1.5 feet of fill /and 0.5 <br />feet of additional fill in lieu of soil (consistent with those conditions specified in the 1996 <br />Technical Revision) for this portion of the agricultural stockpile and storage location, or <br />approximately 2.0± feet of total fill. Area 3 (B) will require the same over 5.0± acres, <br />for a total of 8.3± acres. <br />All other excavation is complete, including two basins which have been lined and <br />approved by the Colorado Division of Water Resources, as provided in previous <br />correspondence consistent with the approved 2010 Technical Revision. All other <br />aspects of the affected land and planned reclamation are attended to further under <br />Exhibit E — Reclamation Plan and Exhibit L — Reclamation Costs; and attending maps. <br />Varna Companies, Inc.
