The decision date for this permit application is September 19, 2011. The Division of Reclamation, <br />Mining, and Safety (Division) is required to make a decision by September 19, 2011. Therefore, your response to <br />the following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land, if applicable. Proof of notice may be return receipts <br />of a Certified Mailing or proof of personal service. <br />2. This rule requires that Maps, except the index map, must be prepared and signed by a registered land <br />surveyor, professional engineer, or other qualified person. The application proposes that an enclosed, signed <br />letter be accepted in lieu of signatures on the prepared maps and that signed maps will be completed prior to <br />construction of the mining project. Please be aware that, with regard to the pre - mining and mining plan maps, <br />the applicant must submit the official, finalized, signed versions of these documents for Division review prior <br />to approval of the application. Please submit signed copies of these maps. <br />3. Included in this exhibit, the Applicant states, "The main entrance and access road are outside of the legal <br />description provided on EXHIBIT A....The area of the access road (affected land) is estimated to be 3.3 <br />acres." If the area referred to above is not bonded with the county as part of the acceleration and deceleration <br />lanes, then the area must be included in the Division permit and therefore must be included in the description <br />on Exhibit A, on all the maps, and included in the permitted acreage. Please clarify the information contained <br />in this statement and submit the applicable materials if addition of this area is necessary. <br />4. Map C -9 includes the following statement, "Any settlement or soil accumulations beyond the property limits <br />due to grading or erosion shall be repaired immediately by the contractor." <br />Please be aware that the Operator shall be held responsible for any disturbance outside of the permit boundary <br />and may be subjected to enforcement action by the Division and the Mined Land Reclamation Board. <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
