b. In addition, the cost of preparing an application to the County for a conditional use permit <br />or waiver request to zoning and planning regulations, as well as the application fee for <br />such an application, and the cost of obtaining bonding for that permit or waiver, even if <br />granted, is beyond our financial ability at this time, and in the immediate future. <br />c. We do not believe that we can obtain bonding for reclamation, based on our own <br />financial circumstances, general economic conditions, and expected county objections, <br />and do not expect to have any ability to post a cash or similar bond for reclamation. <br />d. We clearly do not have the knowledge and experience necessary to prepare and submit an <br />application for a Construction Materials 110 Reclamation Permit, and must therefore hire <br />someone who can assist us in this effort. Nor do we have the ability to pay the <br />mandatory application fee, at this time, or within 180 days of the Board's effective date <br />(the 6 of December, 2011). If we have to sell property to raise money to pay the <br />penalty, we will have even less ability to pay the cost of preparation or application fee or <br />to post the reclamation bond by that time. <br />e. Therefore, if we must apply for a reclamation bond, we request that the Board reconsider <br />the 180 -day timeframe, and instead allow us 365 days, or until the 9` of June, 2012, to <br />complete and submit such application materials. We are told that the economy is <br />supposed to improve and that we are therefore likely to be able to afford these costs more <br />in 2012 than we can this year. <br />We wish, if it is necessary, to present oral arguments for request for the reconsideration, and the facts and <br />other concerns supporting the request, to the Board at the Board's convenience.
