Permit Area, Disturbed Area, and Production Volumes. The permit area covers approximately <br />6,363 acres. The disturbed area totals 422.0 acres. The surface disturbance includes three <br />existing portal areas; the No. 5 Portals, the No. 5A Portals, and the No. 9 Portals. Access to the <br />No. 6 Mine is from within the existing areas of the No. 5 Mine. This access is through the 5A <br />Portals. No new surface disturbance was caused by driving ramps from the F seam (No. 5 Mine) <br />down to the E seam (No. 6 Mine). The E -Seam mining was approved with Technical Revision 4, <br />approved on 9 May 1986. <br />There have been no Notices of Violation issued against the Williams Fork Mines permit since <br />the last Permit Renewal (RN -05) in May 2009. The last Notice of Violation issued at the mine <br />was in 2002. <br />II — REVISIONS TO THE PERMIT <br />The following is a summary of the revisions to the permit since the approval of Permit Renewal <br />05 on 22 May 2009. <br />Minor Revision 48 was received on 21 December 2009, deemed complete on 30 December 2009 <br />and approved on 25 January 2010. This revision changed the mine name from the Eagle Mine <br />Complex to the Williams Fork Mines. <br />Minor Revision 49 was received on 3 February 2011, deemed complete on 14 February 2011 and <br />approved on 18 March 2011. This revision changed the name of the mine operator from BTU <br />Empire Company, LLC to Moffat County Mining, LLC. <br />Partial Phase II Bond Release SL -02 was submitted on 17 September 2004, deemed complete on <br />20 October 2004 and subsequently withdrawn on 4 August 2010. The bond release was for the <br />release of liability for surface subsidence effects for areas overlying the underground workings. <br />III - STIPULATIONS <br />There are no active stipulations on the Williams Fork Mines permit. <br />IV — MIDTERM REVIEW AND ADEQUACY QUESTIONS <br />(Pursuant to Rule 2.08.3) <br />The following adequacy questions need to be resolved with the submittal of a minor, technical or <br />permit revision, as appropriate.
