reclamation cost estimate, for the remaining reclamation at the site, to be <br />included in the permit as Exhibit 4.4 -1. <br />Rule 3.02.4 — Form, Conditions and Terms of Performance Bonds <br />13. Exhibit 2.11 -1 contains a copy of the Certificate of Deposit, which is the bond <br />instrument, for the Coal Ridge Mine. The CD in the exhibit is an old CD from <br />First Interstate Bank in the amount of $1 00,000.00. The current CD is Certificate <br />of Deposit No. 0133666870 from Wells Fargo Bank West, N.A. in the amount of <br />$43,200.00. Please update Exhibit 2.11 -1 with the current Certificate of <br />Deposit from Wells Fargo Bank West, N.A. <br />Rule 3.03 — Release of Performance Bonds <br />14. The Coal Ridge Mine has been granted a full Phase II Bond Release for the entire <br />disturbed area (SL -02, approved on 17 August 2001). The mine was originally <br />reseeded in 1994. The mine has met the minimum ten -year liability period for <br />seeking a full Phase III Bond Release. Please provide the Division with a <br />discussion regarding the plans for the Coal Ridge Mine and the possible timing <br />for application for a Phase III Bond Release. <br />Rule 4.15 - Revegetation <br />15. Page 4 -62a of the approved permit states that a 14.8 acre portion of the Coal <br />Ridge Mine has a post- mining land -use of irrigated pasture. This determination is <br />based on Exhibit 4.4 -3, which is the correspondence with the Natural Resource <br />Conversation Service (NRCS) in 1997. This determination was made in part <br />because the lower portion of the Coal Ridge Mine has been mapped as an alluvial <br />valley floor (the NRCS did recommend that the area be reclaimed to dry <br />pastureland prior to learning that the area was an AVF). The AVF area was <br />reseeded with a pastureland seed mix and the Division found that there were <br />pastureland grasses growing in the AVF area during the Division's Phase II Bond <br />Release SL -02 inspection (SL -02 was approved on 17 August 2001) and that the <br />production met the required standard. On recent inspections the Division has <br />noted pastureland grasses and alfalfa in the AVF area. There was, however, no <br />evidence of any current or past irrigation practices, as required by the permit. <br />Please provide the Division with a plan to establish the necessary 14.8 acres <br />of irrigated pasture. The plan should include any additional species to be <br />interseeded, the timing of the planting, the method of irrigation, proof of <br />water rights for the irrigation and any other necessary information. Please <br />include a map or plate with the proposed location of the irrigated pasture. <br />16. On recent inspections it has been noted that there is a large infestation of Russian <br />and Diffuse Knapweed on the reclaimed portion of the Coal Ridge Mine. There is <br />a weed management plan on page 4 -60 of the approved permit that does discuss <br />the presence and treatment of Russian and Diffuse Knapweed with Banvel and/or <br />
