Box 459 <br />Florence, CO 81226 <br />RE: Marr Mine, Permit C- 1980 -006 <br />Certified Sediment Pond Inspection Report <br />Dear Mr. Patterson: <br />A certified sediment pond inspection report was received by the Colorado Division of Reclamation, Mining, <br />and Safety (Division) on May 12, 2011. Mr. Brian Len at Northwest Colorado Consultants, Inc. (NWCC) <br />inspected the Loadout Pond on May 9, 2011. Per the report, the pond was functioning as designed at the time of <br />the inspection. Mr. Len did recommend maintenance of the embankment beside the outlet channel. Willows <br />and root balls should be removed and holes filled and compacted. The Division concurs with these <br />maintenance needs. <br />The Division has reviewed and found the report to be in compliance with Division regulations 4.05.9(14) and <br />4.05.9(15). Although Rule 4.05.9(15)(d) states that pond inspection reports should include the existing storage <br />capacity of each impoundment, this information was provided in September 2010. At that time, the pond was <br />found to have ample storage capacity, and there was no need for sediment removal at that time.
