6. Is groundwater expected or presently known to exist at the depths of the potash bed (in which the diesel -
based mud will be used)? Will there be any ingredient in the mud to help break down the hydrocarbons to
mitigate contamination?
7. It appears likely that some amount of diesel -based mud will become a permanent residue in the borehole.
Please explain how the use of diesel -based mud will not adversely impact groundwater aquifers.
8. Reclamation plan: The reclamation plan includes a revegetation plan. The seed mix provided appears
adequate for the rangeland in those areas, but the Division must defer to the BLM for the seeding
requirements. Please verify whether this seed mix recommendation was provided to you by the BLM, or that
you will forward a copy of such to the Division. For now, this seed mix will be used to estimate the bond
amount.
9. The seed bed preparation should include ripping, chiseling or discing to loosen the compaction prior to
topsoil replacement and seeding. After topsoil replacement the seedbed should be firm but not overly re-
compacted. If seed are broadcast, the surface should be lightly dragged to incorporate the seed to a shallow
depth.
10. The Division recommends that all woody brush that was stripped prior to drill pad construction should be
scattered on the disturbed area after seeding.
These are the deficient items that require more information at this time. The adequacy responses should be clear and
complete enough to be technically adequate and to allow estimate of the bond amount, as appropriate. Please provide
your responses within 60 days. Once all deficiencies in the NOI have been addressed and the bond amount has been
set, you will need to provide a bond on one of the financial warranty forms found on our website. Please go to:
www.mining.state.co.us / then click on "Forms, Policies & Guidelines." From that page, click on "Mineral
Exploration and Prospecting Forms," and choose a pdf bond form. Make sure you use one that is for "prospecting on
BLM land," which will be among the last eight forms listed at the bottom of that page.
If you have questions you may reach me at the Division's Durango Field Office: 691 CR 233, Room A -2, Durango,
CO 81301; telephone: 970 - 247 -5193.
Sincerely,
F'd
of how much will be used, how much is expected to be recovered (if any), and what type of handling and
disposal is required. Will the diesel -based mud include any constituent to help allow better recovery or
flushing?
Bob Oswald
Environmental Protection Specialist
Ec: Steve Shuey, DBMS Grand Junction
James Blair, BLM Dolores (via electronic copy)
(c: \11 -06 docs \Colo Potash NOI adg01 /rco)
