Hickenlooper <br />Governor <br />Mike King <br />Executive e Director <br />Dick Wolfe, P.S. <br />Director/State Engineer <br />Dear Ms. Hatcher: <br />We have reviewed your letter dated February 14, 2011, requesting renewal of the above <br />referenced substitute water supply plan to cover depletions caused by an existing mining <br />operation. The required fee of $257.00 for the renewal of this substitute supply plan has been <br />submitted (receipt no. 3649127). The original supply plan was approved on December 3, 2001 <br />and was most recently renewed on May 3, 2010 for operations through March 31, 2011. <br />Plan Operation <br />This plan seeks to replace depletions resulting from mining operations at the Hokestra <br />gravel pit (well permit no. 63693 -F, WDID 0503006), operated by Weld County ( "County "). The <br />County does not intend to operate the Hokestra Pit for mining during this SWSP period, <br />therefore the only depletions at the site during this SWSP period will be evaporation from <br />exposed ground water and water used for irrigation at Weld County's Southwest Service Center. <br />The proposed replacement sources are 3.75 Rural Ditch shares owned by Weld County, <br />storage of excess credits in Varra Companies' Tined 112 Pit (WDID 0504001), fully consumable <br />water leased from the St. Vrain & Left Hand Water Conservancy District, and water leased from <br />the City of Greeley. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the <br />Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel <br />mining operators must comply with the requirements of the Colorado Reclamation Act <br />and the Mineral Rules and Regulations for the protection of water resources. The April <br />30, 2010 letter from DRMS requires that you provide information to DRMS to demonstrate <br />you can replace long term injurious stream depletions that result from mining related <br />exposure of ground water.
