Director/State Engineer Dear Ms. Hatcher: We have reviewed your letter dated February 14, 2011, requesting renewal of the above referenced substitute water supply plan to cover depletions caused by an existing mining operation. The required fee of $257.00 for the renewal of this substitute supply plan has been submitted (receipt no. 3649127). The original supply plan was approved on December 3, 2001 and was most recently renewed on May 3, 2010 for operations through March 31, 2011. Plan Operation This plan seeks to replace depletions resulting from mining operations at the Hokestra gravel pit (well permit no. 63693 -F, WDID 0503006), operated by Weld County ( "County "). The County does not intend to operate the Hokestra Pit for mining during this SWSP period, therefore the only depletions at the site during this SWSP period will be evaporation from exposed ground water and water used for irrigation at Weld County's Southwest Service Center. The proposed replacement sources are 3.75 Rural Ditch shares owned by Weld County, storage of excess credits in Varra Companies' Tined 112 Pit (WDID 0504001), fully consumable water leased from the St. Vrain & Left Hand Water Conservancy District, and water leased from the City of Greeley. In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires that you provide information to DRMS to demonstrate you can replace long term injurious stream depletions that result from mining related exposure of ground water. The DRMS letter identifies four approaches to satisfy this requirement If the information you of that information included under the approaches numbered 1— 3, a copy to also be provided to this office (the Division of Water Resources).
