An example of this type of inter - agency communication is the letter dated November 23, 2010 <br />(Exhibit 4) from the Division of Water Resources to the DRMS as part of the review process for <br />the WFC application for a coal mine permit at the New Horizon North Mine. WFC had an <br />understanding that this type of interaction was occurring between the two agencies and there had <br />been no communication to WFC either written or verbally to the contrary. <br />In the Division of Water Resources November 23 letter, the concern that these nine monitoring <br />holes were not recorded was provided to DRMS. Once this information was forwarded to WFC <br />by DRMS, applications and fees for the monitoring holes were provided to the Division of Water <br />Resources to remedy this situation. Permits were then issued on May 25 2011. <br />In the future, WFC will provide the proper notifications and pursue applicable permits separately <br />through the Division of Water Resources on ground water related issues.
