Corey Heaps
CAM Colorado LLC
June 21, 2011 Page 53
99. Please add measurement units to each of the constituents listed in Table 2 on permit text
page 2.05 -57 of Section 2.05.6(3)(b)(iv).
CAM Response: Table 2 has been revised, please see page 2.05 -58
Division Response: Response accepted.
Rule 2.06.6 Special Categories of Mining
99a. Under 2.06.6 Prime Farmlands, please provide a reference to the letter from NRCS in
Exhibit 8.
Rule 2.06.8(3) Alluvial Valley Floor Determination
100 -112. CAM presented a revised Alluvial Valley Floor (AVF) report prepared by ERO
Resources Corporation based on comments 100 - 112. This report is found in Volume 1
Tab 14 of the PAP. The information found in this report was adequate to make a negative
alluvial valley floor determination within the permit boundary of the Fruita Loadout site.
CAM added specific answers /comments on Adequacy Items # 104,107 & 108. See
comments below for additional edits and clarification.
100 -103. Responses accepted and all items resolved.
104. Rule 2.06.8(3)(b)(ii) requires a map of all lands that are currently or were historically flood
irrigated. In the first paragraph on page 2 of the AVF report, there is a statement that says
the area immediately adjacent to both the east and west sides of Reed Wash do not appear
suitable for farming. The last sentence in the first paragraph on page 2 states that based on
a review of current aerial photos, agriculture is limited to hay production, irrigated via a
series of ditches. It is not clear where the ditches are located in relation to the permit
boundary or where the hay production is. Please provide a map showing the hay fields and
irrigation ditch system and all lands that are currently flood irrigated.
CAM Response: Please see new Map -22 showing irrigated hay fields and the irrigation
ditch system.
Division Response: Response accepted.
105 -106. Responses accepted and all items resolved.
107. Rule 2.06.8(3)(b)(iii), requires a map of all lands in the area subject to agricultural
activities, showing types and accompanied by measurements of vegetation in terms of
productivity and type. The report indicates that agricultural activities are to the north of the
proposed permit area and one small area south of the Highway 50 just west of Reed Wash.
