Pineda <br />Director <br />Re: Fruita Loadout (Permit No. C-2010-088) <br />New Pen Application, Adequacy Review No. 2 <br />Dear Mr. Heaps: <br />The Division of Reclamation, Mining and Safety (Division) has reviewed CAM Colorado, <br />LLC's (CAM's) adequacy response letter for the Fruita Loadout new permit application received <br />by the Division on April 12, 2011. The Division has additional adequacy concerns based on <br />your responses to our comments. Our original questions are listed below and correspond to the <br />original numbered paragraphs contained in our adequacy review letter dated November 30, 2010. <br />These are followed by the CAM response and the Division's current response. Where we still <br />have remaining issues, I have bolded text under the Division's response. Where we have related, <br />but new questions based on the revised information, the new question is numbered, for example <br />15a, and is also bold text in its entirety. <br />Rule 2.03 Legal, Financial, Compliance and Related Information <br />1. An Applicant Violator System (AVS) evaluation check was done on November 22, 2010 <br />and there are no violations listed. The Division has the following comments regarding <br />the ownership and control information contained in Section 2.03 of the PAP. <br />Rhino Energy LLC <br />a. Per the Organization Charts, pages 2.03 -14 & -15, Rhino Energy WV LLC owns 51% of <br />Rhino Eastern LLC. AVS shows that Rhino Energy, LLC owns 51 % of Rhino Eastern, <br />LLC. Please have AVS updated or correct the Organization Charts. <br />CAM Response: Please see revised pages 2:03 -15 & 16 <br />b.
