Dear Mr. Heaps:
The Division of Reclamation, Mining and Safety (Division) has reviewed CAM Colorado,
LLC's (CAM's) adequacy response letter for the Fruita Loadout new permit application received
by the Division on April 12, 2011. The Division has additional adequacy concerns based on
your responses to our comments. Our original questions are listed below and correspond to the
original numbered paragraphs contained in our adequacy review letter dated November 30, 2010.
These are followed by the CAM response and the Division's current response. Where we still
have remaining issues, I have bolded text under the Division's response. Where we have related,
but new questions based on the revised information, the new question is numbered, for example
15a, and is also bold text in its entirety.
Rule 2.03 Legal, Financial, Compliance and Related Information
1. An Applicant Violator System (AVS) evaluation check was done on November 22, 2010
and there are no violations listed. The Division has the following comments regarding
the ownership and control information contained in Section 2.03 of the PAP.
Rhino Energy LLC
a. Per the Organization Charts, pages 2.03 -14 & -15, Rhino Energy WV LLC owns 51% of
Rhino Eastern LLC. AVS shows that Rhino Energy, LLC owns 51 % of Rhino Eastern,
LLC. Please have AVS updated or correct the Organization Charts.
CAM Response: Please see revised pages 2:03 -15 & 16
b. In AVS, Castle Valley Mining LLC is owned by Rhino Energy LLC 100% but is not
listed on the Organization Charts in the permit.
