BOX 346 Director <br />Nucla, CO 81424 <br />Dear Ms. Turner: <br />Thank you for the FAX transmittals received by the Colorado Division of Reclamation, Mining and <br />Safety (DRMS) on June 2, 2011, June 3, 2011 and June 4, 2011 regarding your concerns related to <br />hay crop management at the Western Fuels - Colorado LLC, (WFC) New Horizon Mine. I enclose a <br />copy of the FAX documents for our respective records. <br />The DRMS reviewed your allegations in detail. At this time, the crop management and vegetation <br />sampling activities within the New Horizon Mine permit area appear to be occurring as allowed by <br />the applicable legal, regulatory and permit requirements.
