PERMIT #: M-1981-107 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: June 15, 2011 <br />OBSERVATIONS <br />This was a routine site monitoring inspection conducted by DRMS at the Buster Quarries site. This is a 112c <br />sandstone quarry operation. The inspection was conducted by Eric Scott of CDRMS. The DRMS <br />representative met with permittee Bernard Buster at the site office at approximately 1200. There is an <br />identification sign was present near the entrance to the "process" area; however, the operation name should read <br />"Buster Quarries" according to the DRMS permit (not "Lyons Stone"). The sign will need to be modified to <br />have the correct operation name by the corrective action date listed above. <br />A total of 173 acres are currently permitted at this site. The disturbance at the site is less than the 173 permitted <br />acres; however, the current bond amount for this site is $132,600, which as noted in the 2006 inspection report, <br />would still be insufficient for the State to reclaim the disturbed areas at this point. If adequate reclamation is <br />not performed by the corrective action date listed above so that the existing bond is again sufficient, the <br />Division will be required to send a separate surety increase notice to the operator regarding the increase of the <br />financial warranty. The operator will have 60 days from the date on the surety increase notice to post the <br />additional financial warranty. The operator may also prepare a defensible estimate that meets the state <br />requirements for submittal and consideration by the Division. <br />An area of impounded surface runoff/groundwater was noted near the "Number 10" area. State Engineers' <br />Office (SEO) regulations state that surface drainage cannot be impounded for longer than 72 hours unless the <br />appropriate water rights have been approved by the SEO. Therefore the operator will need to either secure SEO <br />approval to impound and retain runoff on site, or pump out this water ASAP and insure that future runoff is not <br />retained for longer than 72 hours. See attached photo. <br />During the site tour it was observed that in the southeast area of the permit there are several fuel tanks with <br />inadequate secondary containment. Adequate impermeable secondary containment will need to be put into <br />place for these tanks, or the tanks will need to be emptied and removed. There was also an area of stained soils <br />that have been impacted by a fuel/oil release that will need to be properly remediated ASAP. See attached <br />photos. <br />Weed control activities may also need to be conducted at the site to control cheatgrass, bindweed, knapweed <br />and any other noxious weeds present. <br />Other activities on the site appear to be in compliance with the approved mining plan at this time. <br />Page 3 of 5 <br />I A
