PERMIT #: M-2005-059 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: June 16, 2011 <br />INSPECTION TOPIC: Topsoil <br />PROBLEM/POSSIBLE VIOLATION: Problem: The topsoil stockpiles do not have established vegetation on <br />them and are therefore susceptible to erosion or excessive noxious weeds. Rule 3.1.9(1) states if topsoil is not <br />replaced into the backfill area within a time short enough to avoid deterioration of the topsoil, vegetative cover or <br />other means shall be employed so that the topsoil is protected from erosion/noxious weeds. <br />CORRECTIVE ACTIONS: The operator shall seed the stockpiles with the seed mix that was submitted as part <br />of the approved Reclamation Plan. If no seed mix has been provided, the operator shall submit a seed mix for <br />approval as a technical revision to the permit along with the appropriate $216 revision fee to the Division by the <br />corrective action date. The Operator shall demonstrate compliance by submitting seed tags, a bill of sale or <br />photographs of seeding activities. The Operator may also request a follow up inspection. <br />CORRECTIVE ACTION DUE DATE: 7/29/11 <br />OBSERVATIONS <br />This was a routine site monitoring inspection conducted by DRMS at the Nelson Mining Resource site. The <br />inspection was conducted by Eric Scott of CDRMS. The DRMS representative met with Rob Laird of Asphalt <br />Specialties at the site at approximately 0900. The site entrance is located off the north side of County Road 26 <br />immediately west of the intersection of County Roads 26 and 15. The site is fenced and the identification sign <br />was present at the site entrance. <br />Only about 50% of this site has been disturbed to date, the rest remains undisturbed agricultural land. This site <br />has also been inactive for at least a year and needs to be put into temporary cessation status as noted above. The <br />site appears to have been in compliance with the mining plan while it was operational. There is a sorting plant <br />and a portable cement plant still located on the north area of the site. The observed fuel tanks associated with <br />the plant area were reported to be empty at this time. The required modifications to the SWSP associated with <br />the now-flooded pit are under review by the State Engineer's Office (SEO) at this time. <br />Weed control activities need to be conducted at the site to control cheatgrass, bindweed and tamarisk. The <br />topsoil and overburden stockpiles also need to be seeded and stabilized to prevent erosion and control weeds <br />while the site is inactive. <br />Page 2 of 4 <br />
