PERMIT #: M-2005-059
INSPECTOR'S INITIALS: ECS
INSPECTION DATE: June 16, 2011
INSPECTION TOPIC: Topsoil
PROBLEM/POSSIBLE VIOLATION: Problem: The topsoil stockpiles do not have established vegetation on
them and are therefore susceptible to erosion or excessive noxious weeds. Rule 3.1.9(1) states if topsoil is not
replaced into the backfill area within a time short enough to avoid deterioration of the topsoil, vegetative cover or
other means shall be employed so that the topsoil is protected from erosion/noxious weeds.
CORRECTIVE ACTIONS: The operator shall seed the stockpiles with the seed mix that was submitted as part
of the approved Reclamation Plan. If no seed mix has been provided, the operator shall submit a seed mix for
approval as a technical revision to the permit along with the appropriate $216 revision fee to the Division by the
corrective action date. The Operator shall demonstrate compliance by submitting seed tags, a bill of sale or
photographs of seeding activities. The Operator may also request a follow up inspection.
CORRECTIVE ACTION DUE DATE: 7/29/11
OBSERVATIONS
This was a routine site monitoring inspection conducted by DRMS at the Nelson Mining Resource site. The
inspection was conducted by Eric Scott of CDRMS. The DRMS representative met with Rob Laird of Asphalt
Specialties at the site at approximately 0900. The site entrance is located off the north side of County Road 26
immediately west of the intersection of County Roads 26 and 15. The site is fenced and the identification sign
was present at the site entrance.
Only about 50% of this site has been disturbed to date, the rest remains undisturbed agricultural land. This site
has also been inactive for at least a year and needs to be put into temporary cessation status as noted above. The
site appears to have been in compliance with the mining plan while it was operational. There is a sorting plant
and a portable cement plant still located on the north area of the site. The observed fuel tanks associated with
the plant area were reported to be empty at this time. The required modifications to the SWSP associated with
the now-flooded pit are under review by the State Engineer's Office (SEO) at this time.
Weed control activities need to be conducted at the site to control cheatgrass, bindweed and tamarisk. The
topsoil and overburden stockpiles also need to be seeded and stabilized to prevent erosion and control weeds
while the site is inactive.
