112778-1 <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, <br />'Mining and Safety proposes to Ap- <br />prove Technical Revision Application <br />No. 90 (TR-90) for the Colowyo Coal <br />Mine (Permit No. C-1981-019), submit- <br />ted by Colowyo Coal Company L.P. <br />Ownership of the land affected by <br />TR-90 is federal, state, and private. <br />-The application provides a technical <br />demonstration that runoff from a <br />2.7-acre topsoil stockpile and a <br />0.4-acre access road will meet effluent <br />limitations and water quality require- <br />ments for downstream waters, without <br />a sediment control pond or other treat- <br />ment. The application also provides <br />documentation that an electric power <br />transmission line owner has no objec- <br />tions to the mine operator's application <br />for Phase III (final) bond release in the <br />area along the transmission line <br />right-of-way. The bond release appli- <br />cation, file SL-05, has been submitted <br />separately from the application for <br />TR-90. <br />The Colowyo Coal Mine is a surface <br />coal mine located in Moffat County, <br />approximately 28 miles south of Craig, <br />Colorado. Coal interest is Federal, and <br />the surface affected is Federal, state <br />and private land. The permit area en- <br />compasses approximately 12,250.95 <br />acres. <br />-This proposed decision is based on a <br />finding that the proposed operation will <br />comply with all requirements of the <br />Colorado Surface Coal Mining Recla- <br />mation Act, Section 34 33 101, et seq., <br />C.R.S., and the regulations promul- <br />gated thereunder. <br />Copies of the proposed decision, in- <br />cluding stipulations, are on file for pub- <br />lic inspection at the Colorado Division <br />of Reclamation, Mining and Safety, <br />Room 215, Centennial Building, 1313 <br />Sherman Street, Denver, Colorado <br />80203. Persons with an interest that <br />may be adversely affected by the pro- <br />posed decision may request a formal <br />hearing before the Mined Land Recla- <br />mation Board on the proposed deci- <br />sion. Such request must be made <br />within ten (10) days of the initial publi- <br />cation of this notice, must be in writing, <br />and must state with reasonable specif- <br />icity the reasons for the request and <br />the objections to the proposed deci- <br />sion. <br />Published in The Craig Daily Press <br />Publication Date: May 20, 2011 <br />10262984
