MAY/26/2011/THU 04;21 PM FAX No. P,002 <br />5. On September 29, 2010, the Operator submitted conversion application <br />CN01 ("CN01"), which the Division found incomplete on October 12, 2010. The <br />Division found CN01 complete for purposes of filing on January 10, 2011 and, on that <br />date, notified the Operator. <br />6. Approval of CN01 will resolve violations numbers MV-2009-007, MV- <br />2009-033, MV-2009-035 and MV-2010-001. <br />7. The Division received objections to CN01. On March 14, 2011, the <br />Division deemed the CN01 "complex" and set a May 2, 2011 decision recommendation <br />date with a formal public hearing scheduled for June 8-9, 2011. <br />8. On April 18, 2011 the Operator filed a response to the Division's CN01 <br />adequacy review. The Division found that the Operator's adequacy response <br />constituted an amendment to CN01 and notified the Operator on April 27, 2011 <br />("April 2011 Amendment"). <br />9. On April 27, 2011, the Operator submitted a letter to the Division <br />requesting to proceed with the April 2011 Amendment, acknowledging extension of <br />the decision deadline to June 21, 2011 and scheduled formal public hearing to the <br />July 13-14, 2011 Board meeting. <br />10. The original 180- day Board-ordered deadline is set for July 9, 2011. <br />11. To facilitate processing of the April 2011 Amendment, an extension of <br />the decision deadline is necessary. An extension of five (5) days, to July 14, 2011 <br />will allow adequate time for the required public notice and public comment periods. <br />The extension will allow this conversion application CN01, to which the Division <br />has received objections, to be considered for approval, denial, or conditional <br />approval at the July 2011 Board meeting. <br />12. It is appropriate and within the Board's discretion to grant an <br />extension of the decision deadline. <br />ORDER <br />Based on the foregoing, the Board grants the Operator's request for an <br />extension of the decision deadline to July 14, 2011.
