I enclose a copy of that FAX for our <br />respective records. <br />Although matters involving any ongoing litigation must be managed through and with the support of <br />our legal counsel, I continue to be available for assistance with any and all matters associated with <br />the regulatory duties of DBMS. As confirmed in the previous letter sent to you from Mr. Mike King <br />dated April 1, 2011 (copy attached) and the letter sent to Mr. McAnany from Mr. Jeff Fugate dated <br />June 3, 2011 (copy attached), we encourage you to communicate directly with DRMS in matters <br />involving any coal mine regulatory issues. <br />You have always been welcome to contact me and I reassert that position here.
