PERMIT #: M-2000-103 <br />INSPECTOR'S INITIALS: RCO <br />INSPECTION DATE: May 11, 2011 <br />OBSERVATIONS <br />This was a routine inspection performed by the Division as part of its monitoring of Construction Materials <br />110c permits, and in response to the landowner's request for an inspection to discuss reclamation issues. <br />Dave Dillon, the landowner, was present throughout the inspection. The entrance road to the site was <br />secured by a locked cable, and access for this inspection was gained on foot. The site has been in "final <br />reclamation" for several years, including removal of equipment and backfilling the hill slope, but progress <br />toward finishing the reclamation has apparently ceased. Mr. Dillon stated that the operator still has right-of- <br />entry to complete reclamation at the site. There is still an accumulation of woody debris and brush on the site <br />that needs to be removed, as well as small piles of stones that should be graded out or removed. Some <br />revegetation seeding may have been carried out on the hill slope, but germination and survival is poor. <br />Predominant vegetation is annual weeds (mainly kochia) and there is no apparent control of the Canada <br />thistle. See further discussion below. <br />Backfilling and Grading: <br />The hill slope has been backfilled to an acceptable gradient. No further backfilling is required at this time. The <br />bench is fairly level and stable, although it still contains materials to be removed. <br />Financial Warranty: <br />The bond consists of a corporate surety #3-666-405 issued by The Ohio Casualty Insurance Company in the <br />amount of $7,500. Unless a significant amount of the reclamation work needs to be repeated, the bond is <br />sufficient to perform the remainder of the reclamation. <br />Roads: <br />The ramp road providing access to the site from the County Road is to be a permanent feature. It is currently <br />considered stable and requires no work at this time. <br />Reclamation Success: <br />Reclamation has begun but it is not finished. Even though the the permitted operator has sold the land (to <br />Mr. Dillon) the outstanding reclamation obligations still remain with the operator. If reclamation tasks are not <br />finished and/or if the site is neglected before reclamation is completed and accepted, site deterioration may <br />occur, resulting in the need for the operator to repeat certain reclamation tasks or the Division to raise the <br />bond amount. <br />The reclamation will require completion of these tasks: clear bench area of brush, rocks and debris; control <br />annual weeds and noxious weeds (thistles); and revegetate the hill slope by seeding it according to the <br />approved seed mix. <br />If the operator does not complete the final reclamation, or comply with the correction of the problems noted <br />in this report, this office may have to hire a reclamation contractor with the bond funds. <br />Revegetation: <br />The bench area is almost covered by the annual weed kochia, which must be eliminated during final <br />reclamation. <br />Page 2 of 3
