The Division will not support any additional mining at the site based on: a) the groundwater issue is not
resolved for current surface exposures. Groundwater exposures are not covered by a well permit or
adequately by a financial warranty and b) without an approved well permit, backfilling of the pits will
require all available materials on site and importation from another site. Additional mining is an issue
that can be revisited once all regulatory and enforcement actions have been fully abated.
If Western Gravel will agree in writing to these stipulations the Division will support reinstatement of
the permit before the MLRB. However, if Western Gravel does not agree with these requirements
Division staff is prepared to object to reinstatement because there are outstanding unabated
enforcement problems that were not addressed and have created site conditions that are not
sufficiently covered by the currently held financial warranty. Please note it is incumbent upon Western
Gravel to ensure that all timeline requirements will be met by consultants, lawyers, and others involved
in representing the operator to finish the water well process as expediently as possible.
If you need additional information please contact me at the Division of Reclamation, Mining and Safety,
Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, or by telephone
no. 970.241.1117.
Sincerely,
G. Russell Means
Environmental Protection Specialist II
Ec: Steve Shuey, Senior Environmental Protection Specialist, West Team Supervisor
