The Division will not support any additional mining at the site based on: a) the groundwater issue is not <br />resolved for current surface exposures. Groundwater exposures are not covered by a well permit or <br />adequately by a financial warranty and b) without an approved well permit, backfilling of the pits will <br />require all available materials on site and importation from another site. Additional mining is an issue <br />that can be revisited once all regulatory and enforcement actions have been fully abated. <br />If Western Gravel will agree in writing to these stipulations the Division will support reinstatement of <br />the permit before the MLRB. However, if Western Gravel does not agree with these requirements <br />Division staff is prepared to object to reinstatement because there are outstanding unabated <br />enforcement problems that were not addressed and have created site conditions that are not <br />sufficiently covered by the currently held financial warranty.
