Broken Arrow Investments, LLC - Derr Pit - Technical Revision No. 2 Request <br />File No. M1008-017 <br />Dear Mr. Cunningham, <br />Broken Arrow Investments, LLC requests a revision to their existing permit to address the following <br />items: <br />1. Mining Methods: Revision of the method of mining to allow for dry mining by dewatering and <br />wet mining without dewatering prior to the installation of the slurry wall. <br />Detailed descriptions of these revisions are in the following sections. <br />Mining Methods: Revision of the method of mining prior to the installation of a slurry wall to <br />include both dry mining by dewatering and wet mining without dewatering if proper notice is <br />given to the DRMS prior to changing from one mining method to another. <br />This letter will serve as notice to the DRMS that Broken Arrow Investments, LLC will mine Phases 2 - 5 <br />by dry mining with dewatering at this time. The dry mining by dewatering will begin after Broken Arrow <br />Investments, LLC receives an approved substitute water supply plan, a well permit, and at such time <br />when the reclamation bond is posted for mining the individual phase (Phase 2) that will expose <br />groundwater. The dry mining methods will not change from the methods described in the original permit <br />approval. <br />Broken Arrow Investments, LLC is also requesting flexibility in the mining methods such that they could <br />convert to wet mining if needed as they get deeper into the gravel resource and dewatering becomes <br />more difficult and expensive prior to the slurry wall installation. The wet mining methods will not change <br />from the methods described in the Technical Revision No. 1 approval. Proper notice in writing would be <br />given to the DRMS prior to changing mining methods by Broken Arrow Investments, LLC.
