b. execution of a letter of intent with La Plata County for roads <br />that will cross the bond release area; <br />C. construction of recreation trails and their dedication to La <br />Plata County; <br />d. engineering, surveying, and legal services expenditures <br />totaling approximately $110,000; <br />e. an option to purchase the Operator's real estate; and <br />f. operation of a commercial sand and gravel pit within the initial <br />Mine reclamation permit and subsequently transferred to an adjacent sand <br />and gravel permit. <br />18. The Operator's letter of intent with La Plata County regarding county <br />roads that will cross the bond release area is a non - binding agreement. <br />19. Although the property was divided into 35 -acre tracts, neither <br />commercial or residential structures have been constructed on the site, nor have <br />building permits, well permits, or septic permits been obtained for construction of <br />such structures. <br />20. The Operator's dedication of an easement for a recreation trail was not <br />developed in the disturbed area proposed for bond release. <br />21. The option to purchase the Operator's property expired without <br />development commencing. <br />22. The commercial and industrial uses cited by the Operator were achieved <br />for areas that were transferred to the sand and gravel permit area adjacent to the <br />SL -04 bond release area. <br />23. The area subject to bond release under SL -04 is open grassland. The <br />only structures in the bond release area are a former haul road, ditches and culverts <br />associated with the haul road, and a rock -lined channel. There are no buildings or <br />utilities on the site. The Operator has conducted traditional reclamation tasks, <br />including backfilling, grading, topsoiling, and re- establishing vegetation. No <br />commercial or residential structures have been constructed on the site. No building <br />permits, well permits, or septic permits have been obtained for construction of any <br />such structures. <br />24. The bond release area is served by electricity that originally served the <br />mining operations.
