STATE OF COLORADO
FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER
IN THE MATTER OF THE APPLICATION OF OAKRIDGE ENERGY, INC.
FOR RELEASE OF RECLAMATION BOND, CARBON JUNCTION MINE,
APPLICATION NO. SL -04, PERMIT NO. C -92 -080
THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on
May 11, 2011 for a hearing to consider the application of Oakridge Energy, Inc.
( "Operator ") to release the reclamation bond for permit number C -92 -080 ( "Permit ").
Assistant Attorney General Jeff Fugate appeared on behalf of the Division of
Reclamation, Mining and Safety ( "Division "). R. Franklin Erisman, Esq. appeared
on behalf of the Operator.
The Board, having considered the parties' presentations and testimony, and
having been otherwise fully informed of the facts in the matter, enters the following:
FINDINGS OF FACT
1. The Operator has a reclamation permit for a coal mine site known as
the Carbon Junction Mine ( "Mine "). The 164.19 -acre site is located in Section 33,
Township 34 1 /2 North, Range 9 West and Section 4, Township 34 North, Range 9
West, New Mexico Principal Meridian, approximately two miles southeast of
Durango, Colorado in La Plata County. Mining activities in the permit area
disturbed 45.31 acres.
2. On July 30, 2008, the Division received bond release application SL -04
( "Application ") from the Operator. The Division found the application incomplete on
September 26, 2008. On that same date, the Division notified the Operator that two
items were required to complete the application: a notarized statement required by
Rule 3.03.2(1)(e) of the Regulations of the Colorado Mined Land Reclamation Board
for Coal Mining, 2 C.C.R. 407 -2 ( "Rules "); and information regarding achievement of
the post- mining land use.
3. The Division received the requested notarized statement and
information on post- mining land use, and found the Application complete on October
10, 2008. The completeness determination was made pursuant to Rule 3.03.2(1)(d).
4. The Application requests Phase II and III (final) bond release on the
45.31 disturbed acres in the permit area. The disturbed area includes the following
areas, which have not previously received Phase I bond release:
a. Topsoil stockpiles 4, 7, and 8;
