BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE APPLICATION OF OAKRIDGE ENERGY, INC. <br />FOR RELEASE OF RECLAMATION BOND, CARBON JUNCTION MINE, <br />APPLICATION NO. SL -04, PERMIT NO. C -92 -080 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on <br />May 11, 2011 for a hearing to consider the application of Oakridge Energy, Inc. <br />( "Operator ") to release the reclamation bond for permit number C -92 -080 ( "Permit "). <br />Assistant Attorney General Jeff Fugate appeared on behalf of the Division of <br />Reclamation, Mining and Safety ( "Division "). R. Franklin Erisman, Esq. appeared <br />on behalf of the Operator. <br />The Board, having considered the parties' presentations and testimony, and <br />having been otherwise fully informed of the facts in the matter, enters the following: <br />FINDINGS OF FACT <br />1. The Operator has a reclamation permit for a coal mine site known as <br />the Carbon Junction Mine ( "Mine "). The 164.19 -acre site is located in Section 33, <br />Township 34 1 /2 North, Range 9 West and Section 4, Township 34 North, Range 9 <br />West, New Mexico Principal Meridian, approximately two miles southeast of <br />Durango, Colorado in La Plata County. Mining activities in the permit area <br />disturbed 45.31 acres. <br />2. On July 30, 2008, the Division received bond release application SL -04 <br />( "Application ") from the Operator. The Division found the application incomplete on <br />September 26, 2008. On that same date, the Division notified the Operator that two <br />items were required to complete the application: a notarized statement required by <br />Rule 3.03.2(1)(e) of the Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining, 2 C.C.R. 407 -2 ( "Rules "); and information regarding achievement of <br />the post- mining land use. <br />3. The Division received the requested notarized statement and <br />information on post- mining land use, and found the Application complete on October <br />10, 2008. The completeness determination was made pursuant to Rule 3.03.2(1)(d). <br />4. The Application requests Phase II and III (final) bond release on the <br />45.31 disturbed acres in the permit area. The disturbed area includes the following <br />areas, which have not previously received Phase I bond release: <br />a. Topsoil stockpiles 4, 7, and 8; <br />
