Therefore, exposure of ground <br />water must not occur during or after mining operations. If stormwater is contained on-site, it must <br />infiltrate into the ground or be released to the natural stream system within 72 hours, or all work <br />must cease until a substitute water supply plan, or augmentation plan approved by water court, is <br />obtained. Reclamation plans must ensure water will not be retained onsite for more than 72 hours <br />unless an augmentation plan approved by water court is obtained. <br />® The proposed operation will consume water by: ® evaporation, ® dust control, <br />? reclamation, ® water removed in the mined product, ® processing, ? other:. <br />The proposed sources of water include ground water from a well constructed under permit no. <br />53789-F (limited to 25 gallons per minute, 20 acre-feet annually for drinking and sanitary facilities <br />in a commercial business, the washing of gravel, concrete production, and dust mitigation) and <br />surface water from the Animas River (conditional water right pending in Division 7 Water Court <br />case no. 2011 CW 1). <br />COMMENTS: Well permit no. 53789-F was issued pursuant to §37-90-137(2), C.R.S., for the construction <br />of a well to divert ground water at a point where unappropriated water is available for withdrawal. <br />However, as noted on the permit, this well may be subject to administration in the water priority system in <br />the future. Without a court approved plan for augmentation or substitute water supply plan, this well may be <br />subject to curtailment should the area become over-appropriated in the future.
