--1g7b RECEIVRP
Dear Berhand Keffelew,
MAY = 2011
C?hrr ion mt -c M&Lian,
My name is Joseph Perrino. We spoke on Thursday May 18th. As I M ning and 4 y
mentioned to you on Thursday, a serious situation has occurred with respect to my CIT
property, which lies adjacent to the Menzer Quarry, run by Schmidt Aggregates,
located at 6045 Turkey Canyon Ranch Road. That also happens to be my address. I
own the 725 acres adjacent to and NE of the Quarry. Starting this winter, the Quarry
began blasting the hillside adjacent my property. The hillside forms the SW wall of
Turkey Canyon. This canyon is often less than 100 feet wide. My property line runs
through the middle of this canyon along with my road and a year around stream.
The road is our family's only access in and out of our property. My road crisscrosses
the stream several times as it approaches our residence. We have placed 3 over
passes in these areas, each with several culverts 3 to 4 feet in diameter to handle the
heavy rains in the summer months. Due to the crisscrossing, my road often lies
directly adjacent the SW wall of the canyon. The canyon walls are for the most part
very steep and unhikeable. When Menzer Quarry began blasting this past winter I
made several calls to Dan Chavez the foreman at the quarry, informing him of what
was happening to my side of the canyon. On two occasions I had to leave messages
that were not returned. I told him that boulders were falling on this side into the
stream and that this was potentially unsafe for several reasons. First we drive along
this narrow canyon and secondly the stream has overflowed before causing severe
damage to the road and expense to myself. Over the past 7 years I have had a good
relationship with the Quarry and assumed that Dan would take care of the problem.
We left for the winter and went to Hawaii where we are trying to sell a home. When
we came back last week May 13th, I was literally sickened by the site. The hillside
was gone and boulders larger than a subzero refrigerator filled the stream over the
top, There were also similar size boulders that had rolled to within 15 feet of my
road, which in that area is on the NE side of the Canyon at the moment. Any medium
to large rainfall and my road is gone along with our only means of access to this very
remote property of ours. Continued blasting and removal of that very important
wall will only make matters worse and place my family in constant danger of falling
boulders due to a weakened hillside. I immediately called Dan who took several
days to get back to me. He told me that they were taking the hillside down. Not until
I asked for a supervisor did I get an apology and a willingness to remove the
boulders in the stream. I told him that I would not allow them on my property with
their large equipment as they had already caused enough damage the way it was.
Turkey Canyon as I have already mentioned is very narrow and pristine. The st - ?_
has been damaged and forever redirected due to their callous disregard-a ife and
property. Scott, a supervisor of Schmidt Aggregates finally called me after you and I
spoke on Thursday and apologized for what had happened. He told me that they
were stopping the work in that area. The problem is that I do not believe that they
will end without an authoritative figure making them. My family and I are in danger
if they continue the removal of SW hillside of the narrow canyon. Further blasting of
the SW hillside of Turkey Canyon will destroy the natural flow of Turkey Canyon
stream and place my Ianrn14 's safbty in )-copardy. flould :r s ca ready occ as-Ionall'4 fall
down from natural causes and with a weakened hillside this will make travel
through the canyon unsafe. I cannot fathom how they could have been so reckless.
