PERMIT #: M-2004-028 <br />INSPECTOR'S INITIALS: JLE <br />IN SPECTION DATE: May 31, 2011 <br />OBSERVATIONS <br />This was a pre-operation inspection of the Broyles Pit; DRMS File No. M-2004-028, operated by Febbraro <br />Construction Company. This site is located approximately 14 miles northeast of Trinidad, Colorado in Las <br />Animas County. I, Jared Ebert of the Colorado Division of Reclamation Mining and Safety (Division) conducted <br />the inspection. Mr. Joseph Febbraro was aware of the inspection but was un-able to accompany me. <br />The current permit area for this site is 9.96 acres, the Operator submitted an amendment application to <br />increase the permit area to 12.96 acres. The site consists of two distinct areas; the east pit area and the west <br />pit area. The Operator is increasing the permit area by three acres to encompass several stockpiles of material <br />found to be outside of the east pits approved northern permit boundary. This issue was cited by the Division <br />in the December 10, 2011 inspection report. <br />The corners of the proposed boundary were marked with white PVC pipe. The Division measured and mapped <br />the proposed permit area using a Trimble GeoXT GPS unit. A map highlighting the Divisions findings is <br />enclosed with this report. For the east pit, the proposed boundary depicted on the maps submitted with the <br />amendment application is different than it is delineated with markers at the site. Given the proposed <br />configuration of the permit boundary from the amendment application, portions of the western end of the un- <br />approved stockpile area would be outside of the western boundary of the east pit. The Operator will need to <br />revise their proposed permit boundary for the east pit to encompass the entire stockpile area outside of the <br />current approved permit boundary. The expansion area will need to be re-configured, but still encompass <br />three acres. An estimate of the necessary revision is depicted on the inspection report map. <br />The west pit is missing two boundary markers at the western end of the site. These markers will need to be <br />replaced. This issue is cited as a problem at the beginning of this inspection report and will require <br />corrective action by the Operator. <br />Page 2 of 5
