COMMENTS ON COLORADO MINING ENTERPRISES 1/6/2011 <br />PLAN OF OPERATIONS <br />I General Information <br />We agree that this is a new mineral exploration project. <br />Response: <br />Since there is no disagreement on this issue, no further continent or discussion is necessary. <br />D., E., F., G. Time frames will depend on finalizing provisions of the Plan of Operations, <br />determining the applicable environmental analysis and mitigation measures, incorporating <br />applicable mitigation measures in the plan, calculating the reclamation bond, and providing the <br />reclamation bond prior to approval. <br />Response: <br />It is understood that these conditions apply. No further comment is necessary. <br />IV. Description of the Operation <br />D. Project Description <br />1. Provide a 1:24,000 scale, or some reasonable approximation, topographic map showing the labeled <br />locations of all roads, pads, and disturbed areas. Clearly label everything and ensure that labels are <br />consistent throughout the POO. The current description references pads AC-2 and AC-7 which differ <br />from the Exhibits. Provide a clear description of each drill pad and any associated surface <br />disturbance. Our field review with Mr. Severo Chavez on April 6, 2011, brought forward questions <br />that needed to be clarified particularly with regard to apparent differences between activities <br />discussed at the site and activity described in the POO. We are particularly concerned with the <br />unresolved questions regarding roads and the disturbance associated with 'Pad 1' which we will <br />discuss with you further. I may also ask a Forest Service senior mining geologist to participate in that <br />discussion. <br />Response: <br />See enclosed operation plan for access descriptions, locations of the four proposed pads and <br />include detailed grading plans for each of the four pads. The location is shown in 1"=200', or a <br />1:2,400 and the pads are shown at 1"=40'. <br />2. Current descriptions in plan are ambiguous as to new roads, old roads to be opened, roads to be left <br />untouched. Clearly depict on a map and use uniform terminology in the plan. The company has <br />recently described some types of roads as 'ways'. The term "ways" in Forest Service Region 2 are by <br />definition considered to be unauthorized roads and are not recognized as anything more. Features you <br />describe as 'ways' are not managed any differently than unauthorized roads. <br />Response: <br />Dirt roads or "ways" as identified in the USFS plans that are to be used during the exploration <br />project are marked and noted on the enclosed operations plan.
