exceed ten (10) cubic yards. While onsite all such material must be protected from weathering and leaching, <br />such as through tarping with an impermeable membrane, to prevent adverse impacts to soil and water. <br />6. The total affected area will be no greater than 3.0 acres, and all activities contained within the patented <br />claims, as shown on the revised Figure 3 and Figure 4 maps. <br />7. The underground activities may affect the mine's existing groundwater. Some of the groundwater will be <br />managed and retained underground, and some will discharge from the mine. All surface water that results <br />from the discharge will continue to be managed so that it reports to the onsite sediment pond. <br />8. The discharge will continue to report to the onsite sediment pond before it continues to Sneffels Creek. The <br />operator will ensure that the discharge conveyance pipe and sediment pond remain functional. All surface <br />drainage and sediment transport will be controlled and directed to the sediment pond. The operator will <br />renew or obtain another permit from the CDPHE for the discharge. Copy of the CDPHE permit will be <br />forwarded to the Division. <br />9. Reference was made in the NOI about a county agreement, in relation to inert waste rock. If the county has <br />agreed to receive or remove waste rock resulting from this prospecting project, please provide a copy of the <br />agreement or a contact person at the county who is knowledgeable about the agreement. At this time, it is <br />the Division's opinion that the county's use of clean rock is acceptable, but all operational parameters and <br />limits stated above still apply. <br />10. If permits are required for use of county or forest system roads, or for other county or forest service <br />requirements, please ensure that those permits are obtained prior to commencing activities, and that this <br />Division is notified when the necessary permits are obtained. <br />11. Water quality testing will continue on a quarterly basis, beginning this year as soon as the site is accessible <br />and continuing until it is no longer accessible, which must include the suite of analytes previously included. <br />The sampling locations that have been used on past sampling dates are satisfactory. Please forward copies of <br />all analyses promptly to this Division. <br />12. Reference was made in the NOI about turbidity being the primary anticipated water quality issue. As such, a <br />functional sediment pond will continue to be a necessary onsite feature. However, to ensure that other water <br />quality issues do not occur undetected, the water sampling will be required, as discussed in the paragraph <br />above. <br />13. The prospecting activities are to occur on pre-disturbed land and accessed by pre-existing roads. There will <br />be no impact anticipated to areas which will involve reclamation that includes topsoil replacement or <br />revegetation. The underground workings are accessible by an existing portal which is currently safeguarded <br />by a locked steel grate that is fairly new and in good condition. This portal and grate will be post- <br />reclamation features of the site and the operator must therefore maintain or replace these as needed <br />throughout the project. If the present features are to be removed or changed, or a different method of closure <br />for reclamation is desired, the NOI must be modified. The reclamation bond estimate will include cost of <br />installing a replacement locked grate. <br />14. Other miscellaneous costs or tasks in the final reclamation will include the placement of a small quantity of <br />waste rock, assuming that there could be some stockpiled but not yet placed against the hill, and the removal <br />and disposal of a small quantity of debris from the site. If the Division observes other conditions in the <br />future that require remediation, clean-up or reclamation, the bond will be revised to include those. <br />The items above are the Division's interpretation and comment concerning topics within our jurisdiction according to <br />information included in the NOI. If any of the items above do not conform to the desired prospecting project, please <br />contact this office promptly. If all items are correct, the operator must submit the bond within 60 days or the NOI <br />may be denied. Response may be sent directly to me at the Division's Durango address below. <br />To submit the bond requires that the operator properly complete one of the financial warranty forms that is available <br />on the Division's website.
