THE OWNER, SITE DEVELOPER, CONTRACTOR AND/OR THEIR 9. <br />AUTHORIZED AGENTS SHALL REMOVE ALL SEDIMENT, MUD, <br />CONSTRUCTION DEBRIS, OR OTHER POTENTIAL POLLUTANTS THAT MAY <br />HAVE BEEN DISCHARGED TO OR, ACCUMULATE IN, THE FLOWLINES, <br />STORM DRAINAGE APPURTENANCES, AND PUBLIC RIGHTS OF WAYS AS <br />A RESULT OF CONSTRUCTION ACTIVITIES ASOCIATED WITH THIS <br />CONSTRUC110N PROJECT. SAID REMOVAL SHALL BE CONDUCTED IN A <br />TIMELY MANNER. <br />2. UNDERSTAND THAT ADDITIONAL EROSION AND SEDIMENT CONTROL <br />MEASURES MAY BE REQUIRED OF THE OWNER AND HIS OR HER <br />AGENTS DUE TO UNFORESEEN EROSION PROBLEMS OR IF THE <br />SUBMITTED PLAN DOES NOT FUNCTION AS INTENDED. THE <br />REQUIREMENTS OF THIS PLAN SHALL BE THE OBLIGATION OF THE <br />LAND OWNER AND/OR HIS SUCCESSORS OR HEIRS; UNTIL SUCH TIME <br />AS THE PLAN IS PROPERLY COMPLETED, MODIFIED, OR VOIDED. <br />10. <br />3. THE CONTRACTOR SHALL PREVENT SEDIMENT, DEBRIS AND ALL OTHER <br />POLLUTANTS FROM ENTERING THE STORM SEWER SYSTEM DURING ALL <br />DEMOLITION, EXCAVATION, TRENCHING, BORING, GRADING, OR OTHER <br />CONSTRUCTION OPERATIONS THAT ARE PART OF THIS PROJECT. THE <br />CONTRACTOR SHALL BE HELD RESPONSIBLE FOR REMEDIATION OF ANY <br />ADVERSE IMPACTS TO ADJACENT WATERWAYS, WETLANDS, ETC., <br />RESULTING FROM WORK DONE AS PART OF THIS PROJECT. <br />APPROVED EROSION AND SEDIMENT CONTROL BEST <br />MANAGEMENT. PRACTICES SHALL BE MAINTAINED AND KEPT IN <br />GOOD REPAIR FOR, THE DURATION OF THIS PROJECT. AT A <br />MINIMUM, THE CONTRACTOR OR HIS AGENT SHALL PRODUCE <br />AND RETAIN WEEKLY WRITTEN INSPECTION RECORDS FOR ALL <br />BMPs AND AFTER SIGNIFICANT PRECIPITA110N EVENTS. ALL <br />NECESSARY MAINTENANCE AND REPAIR SHALL BE COMPLETED <br />IN A TIMELY MANNER BUT IN NO CASE MORE THAN SEVEN(7) <br />CALANDER DAYS AFTER THE INSPECTION. HOWEVER, STREET <br />SWEEPING IS TO BE COMPLETED BY THE CLOSE OF BUSINESS <br />DAY OR ON AN AS NEEDED BASIS. ACCUMULATED SEDIMENT <br />AND DEBRIS SHALL,BE REMOVED FROM A BMP WHEN THE <br />SEDIMENT LEVEL REACHES ONE HALF THE HEIGHT OF THE <br />BMP OR, AT ANY TIME THAT SEDIMENT OR DEBRIS ADVERSELY <br />IMPACTS THE FUNCTIONING OF THE BMP. <br />MODIFICATION OF AN ACTIVE CONSTRUCTION ACTIVITIES <br />STORMWATER DISCHARGE PERMIT BY THE DEVELOPER, <br />CONTRACTOR OR THEIR AUTHORIZED AGENTS SHALL REQUIRE <br />1TMELY NOTIFICATION. DISCHARGE PERMITS EXPIRE IF <br />CONSTRUCTION HAS NOT COMMENCED WITHIN 12 MONTHS OF <br />THE ACCEPTANCE OF THE MANAGEMENT PLAN. <br />6. CONSTRUCTION SHALL COMPLY WITH ALL APPLICABLE <br />GOVERNING CODES AND BE CONSTRUCTED TO SAME. <br />7. UNLESS OTHERWISE SHOWN, NO PROPOSED SLOPE SHALL <br />EXCEED ONE & HALF (1.5) HORIZONTAL TO ONE (1) VERTICAL. <br />ALL SLOPED AREAS MUST BE PROTECTED FROM EROSION. <br />8. THE CONTRACTOR IS RESPONSIBLE FOR CALCULATING HIS OWN <br />ESTIMATE OF EARTHWORK QUANTITIES. <br />4. A LAYER OF SUITABLE MULCH SHALL BE APPLIED TO ALL DISTURBED <br />PORTIONS OF THE SITE WITHIN FOURTEEN (14) DAYS OF THE <br />COMPLETION OF GRADING. SAID MULCH SHALL BE APPLIED AT A <br />RATE OF TWO (2) TONS PER ACRE AND SHALL BE TACKED OR <br />FASTENED BY AN APPROVED METHOD SUITABLE FOR THE TYPE OF <br />MULCH USED. ROUGH-CUT ROADS SHALL BE MULCHED UNLESS A <br />LAYER OF AGGREGATE ROAD BASEā¢OR ASPHALT PAVING IS TO BE <br />APPLIED TO ROUGH-CUT STREETS WITHIN THE 14 DAY PERIOD AFTER <br />COMPLETION OF GRADING. <br />5. THE CONTRACTOR SHALL LOCATE, INSTALL, AND MAINTAIN ALL <br />EROSION CONTROL AND WATER QUALITY BEST MANAGEMENT <br />PRACTICES AS INDICATED ON SHEET C4.20 THRU C4.24, EROSION <br />CONTROL PLANS. <br />6. THE DEVELOPER, GENERAL CONTRACTOR, GRADING CONTRACTOR <br />AND/OR THEIR AUTHORIZED AGENTS SHALL INSURE THAT ALL LOADS <br />OF CUT AND FILL MATERIAL IMPORTED TO OR EXPORTED FROM THIS <br />SITE SHALL BE PROPERLY COVERED TO PREVENT LOSS OF THE <br />MATERIAL DURING TRANSPORT ON PUBLIC RIGHTS OF WAYS. <br />7. THE USE OF REBAR, STEEL STAKES, OR STEEL FENCE POSTS TO <br />STAKE DOWN STRAW OR HAY BALES OR TO SUPPORT SILT FENCING <br />USED AS AN EROSION CONTROL MEASURE IS PROHIBITED. <br />8. SOILS THAT WILL BE STOCKPILED FOR MORE THAN THIRTY (30) DAYS <br />SHALL BE PROTECTED FROM WIND AND WATER EROSION WITHIN <br />FOURTEEN (14) DAYS OF STOCKPILE CONSTRUCTION. STABILIZATION <br />AND PROTECTION OF THE STOCKPILE MAY BE ACCOMPLISHED BY ANY <br />OF THE FOLLOWING: MULCHING, TEMPORARY/PERMANENT <br />REVEGITATION OPERATIONS, CHEMICAL SOIL STABILIZER <br />APPLICATION(REQUIRES WMD APPROVAL), OR EROSION CONTROL <br />MATTING/GEOTEXTTLES.
