Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />In response to a comment by DRMS, on May 6, 20110, Wildcat Mining requested by <br />certified mail that each adjacent landowner sign and notarize a revised Damage <br />Compensation Agreement reflecting the details of Application CN-01 for the May Day <br />Idaho Mine Complex. On June 1, 2011 another request to enter into a Damage <br />Compensation Agreement was sent to adiacent landowners within 200 feet of the permit <br />area. <br />The manmade structures that are within 200 feet of the mine area include utilities (phone <br />and electrical) fences and three domestic wells. All manmade structures have been <br />inventoried and photographed. The owners of the utilities include La Plata Electric and <br />Owest. The owners of wells include: <br />• David and Erin Linden; <br />Ms. Vaught - Compensation Agreement signed; and, <br />Mr. and Mrs. A. Taylor - Compensation Agreement signed <br />Wildcat Mining understands the value of a domestic well; however, the cost effectiveness <br />and the ability to demonstrate whether an activity has or may affect a groundwater well is <br />difficult at best. If given permission, Wildcat Mining will periodically test Mr and <br />Mrs. Linden's 8-foot domestic well for production and quality and will make a <br />commitment to replace the well if mining-related activities adversely affect Mr. Linden's or <br />other domestic well users. <br />Wildcat Mining has signed Damage Compensation Agreements with the following: <br />• Fairview Land Company; <br />• Ms. Vaught; <br />• Mr. and Mrs. A Taylor; <br />• Owest; and, <br />• La Plata Electric. <br />There are no manmade structures considered to be of significance within 200 feet of the <br />permit area for the following individuals: <br />Ken and Verniece Fa erlin Kell Okamura <br />David N. Kin sle U.S. Forest Service-San Juan <br />Citco Properties Liber Communication <br />Ger and Ga Gibbons Charles and Lorraine Ta for <br />Ward Lee Do le E.
