Maintaining the pit slopes during the mining phase at approximately the final reclamation gradient of 3:1 can
significantly reduce the reclamation costs. Do you propose to continue to mine by dozing material down the slope
approximately at the final 3:1 gradient? If not, then what will be the pit slope gradient during mining?
Reclamation Plan - Rule 6.3.4
There are over four acres of disturbance now, and upcoming operations at the pit will expand that disturbance, while
there are no areas presently reclaimed. Given those factors, it is reasonable to project that there could potentially be
seven acres of disturbance at any one time. This office will estimate reclamation costs for seven acres of disturbance,
unless there is a better figure you can provide. Please comment.
This office will begin preparing the reclamation cost estimate, but will await your responses to the items above
before the final figures will be ready. Reclamation tasks that are likely to be included will be: minor pit slope
grading, minor pit floor grading, ripping several acres of compaction, disposal of minor amounts of mining-related
debris, topsoil replacement on slopes and level areas, revegetation of disturbed areas, weed control, and equipment
mobilization from Del Norte. Note: Most of the tasks above will be for areas of less than seven acres.
Damage Agreement for Overhead Electric Lines
Please provide a properly completed agreement for the electric lines that are located within 200 feet of the amended
permit area.
Additional Filing of Permit Amendment Materials
As before, all documents that are submitted by you as part of this amendment application must be additionally filed
(but not recorded) with the county clerk and recorder. Please ensure that you place on file at the clerk's office a copy
of all such materials that you send to me. Be sure to obtain a receipt for the filing and forward that to me also.
All other items are deemed to be adequate, and there are no other items that must be addressed at this time. Please
submit two copies of all response materials, by sending them directly to me at the Division's Durango field office
(address below). Faxes are acceptable, if followed up with hard copies by mail.
Decision Date
The decision date is still set for June 13, 2011. Please provide your responses before that date. If you cannot provide
responses by that date, this office may deny the amendment. However, you may request an extension if needed.
Please contact this office to discuss any questions you have.
I may be reached at the Division's Durango field office: 691 CR 233, Room A-2, Durango, CO 81301; telephone
970-247-5193; fax 970-247-5104.
Sincerely,
Bob Oswald
Environmental Protection Specialist
Ec: Steve Shuey, DRMS Grand Junction
(c:\11-05 docs\soward am01 par/rco)
l «x 4;
