Box 591 <br />5174 Highway 133 <br />Somerset, CO 81434 <br />(970) 929-2200 <br />Fax (970) 929-5050 <br />Re: Mountain Coal Company, LLC, West Elk Mine; Permit No. CO-80-007; Request for Phase I Bond <br />Release, Amended Appendix A <br />Dear Mr. Kaldenbach: <br />Earlier this month Mountain Coal Company, LLC (MCC) submitted a request for Phase I Bond Release <br />for methane drainage well (MDW) and exploration sites and roads that have been reclaimed in the Dry <br />Fork of Minnesota Creek and West Flatiron areas. Included in Appendix A of that submittal was a <br />certification that was stamped and signed by a Professional Engineer certifying that all reclamation was <br />completed in accordance with MCC's approved reclamation plan. During your regular mine site <br />inspection last week, you'd mentioned that the certification needed to be notarized rather than or in <br />addition to the P.E. stamp. As such, attached is an amended certification that has been notarized in <br />accordance with Rule 3.03.2(1)(e). Please replace Appendix A in your copy of the bond release <br />request with the attached Appendix A. <br />MCC has submitted the public notice for the bond release request to the Delta County independent for <br />publication during the next four weeks, starting on June 1St. Following the last publication of the notice, <br />a copy of the affidavit of publication will be forwarded to the Division. MCC understands that upon <br />receipt of that affidavit, the bond release request will be deemed complete and the Division and OSM <br />will then conduct field inspections of the sites to confirm that Phase 1 bond release is appropriate. <br />If you have questions concerning this amended Appendix or require further information, please contact <br />me at (970) 929-2238 or Ryan Sweetwood at (970) 929-2308. <br />Sincerely, <br />llgalib <br />Kathleen G.
