Binns <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />RE( °RVED <br />JUN 022011 <br />DivWon w, ,oclam2iba. <br />Mining and SafeiV <br />Re: Edna Strip Mine permit Renewal Application No. 6 (RN-6) (CHS #59665) <br />Dear Ms. Binns: <br />Thank you for your correspondence dated May 20, 2011 (received by our office on May 24, 2011) <br />regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory database indicates that four cultural resource <br />inventories have been conducted on or near the proposed project area with four sites recorded. The <br />survey report numbers are MC.LM.12319, RT.CH.R2, RT.LM.NR64, RT.LM.R70, and RT.LM.R76. <br />Three sites were officially determined not eligible for listing on the National Register of Historic Places <br />some tune ago. 5RT.1236 and 5RT.2125 were determined officially not eligible on February 2, 1997, <br />and 5RT.266 was determined officially not eligible on December 23, 1981. Site 5RT.2535 remains <br />unevaluated. Given the time since the three determinations of eligibility were made, we recommend <br />that all four sites are re-evaluated or evaluated if they are within the areas of the permit renewal. If site <br />avoidance is not possible, we recommend further consultation with our office in order to identify <br />options to avoid, minimize, or mitigate the adverse effect to the sites. <br />Should human remains be discovered during mining activities the requirements under State law CRS <br />24-80 part 13 apply and must be followed. <br />Thank you for the opportunity to comment.
