PN: 11076P <br />June 2, 2011 <br />LIMITATIONS <br />Page 3 <br />We represent that our services will be performed within the local limits and standards of care <br />within the geotechnical engineering discipline of the area. Our report does not represent <br />expressed or implied warranty. <br />The client must understand that unexpected subsurface soil and water conditions may be <br />encountered during the progression of the project that may influence the chosen design and the <br />performance of the site. <br />The information and recommendations presented in this study are valid ONLY for the proposed <br />construction discussed above and specifically for the project site evaluated in this study. The <br />recommendations presented in this study must not be used for any other structures or project <br />sites. <br />The recommendations presented in this study should be considered as valid for up to one (1) <br />year after the submittal date. Use of the information presented in our study beyond one (1) year <br />after the submittal date is not recommended unless we are contacted to verify the information <br />presented in our report. <br />Insurance <br />During the term of this agreement Trautner Geotech (Consultant) will maintain the following <br />insurance: <br />? General commercial liability, <br />? Automobile liability, <br />? Professional Liability, and, <br />? Workman's Compensation Liability <br />The client does not maintain insurance for the consultant for this project. <br />Indemnification <br />The Client agrees, to the fullest extent permitted by law, to indemnify and hold harmless the <br />Consultant, its' Officers, Directors, Employees (collectively, Consultant) against all damages, <br />liabilities or costs, including reasonable attorney's fees and defense costs to the extent caused by <br />the Client's negligent acts in connections with the project or anyone for whom the Client is <br />legally liable. <br />The Consultant agrees, to the fullest extent permitted by law, to indemnify and hold harmless <br />the Client, its' Officers, Directors, Employees (collectively, Client) against all damages, <br />liabilities or costs, including reasonable attorney's fees and defense costs to the extent caused by <br />the Consultant's negligent acts in connections with the project or anyone for whom the <br />TRAUTNER Zi?P3
