Under Rules 2.05.3(4)(a)(i)(A), 2.05.3(4)(a)(ii)(A) and 2.10(2), please add appropriate <br />certifications to the three sediment pond Figures 2, 3 and 4 found in Appendix 2.05.3(3)-1. <br />Response - Pond drawings have been certified. <br />2.05.3 5 - Topsoil <br />1. A section by this number was not provided with the application submittal. Please revise the <br />PAP to include a section addressing the requirements of this Rule. Conversely, if WFC <br />intends to incorporate the topsoil narrative and maps elsewhere in the permit, please provide <br />a brief section here referring the reader to the location where the required information may <br />be found. <br />Response - The reader has been referred to Section 2.05.4(2)(d) Topsoil Redistribution <br />for a discussion on Topsoil, <br />2. In accordance with the requirements of 2.05.3(5), please also specify the volume(s) of topsoil <br />to be stockpiled and incorporate this information into the PAP text and map. Please describe <br />the methods that will be used to achieve compliance with the topsoil storage requirements of <br />4.06.3. <br />Response -A discussion of the topsoil storage compliance with Rule 4.06.3 is included in <br />Section 2.05.4(2)(d) Topsoil Redistribution. The estimated topsoil volume is 430,000 bank <br />cubic yards. <br />2.053(6) -Overburden <br />1. As with 2.05.3(5), above, the PAP does not provide a narrative specific to Rule 2.05.3(6). <br />Please revise the application to address the requirements of 2.05.3(6), or clearly reference <br />the location where the information may be found. <br />Response - The reader has been referred to Section 2 05.4(2)(c) Backfilling and Grading <br />for a discussion on Overburden. <br />2. 2.05.3(6) also addresses the requirements for temporary overburden disposal (storage) <br />structures. Please note that the proposed overburden stockpile must comply with the <br />applicable performance standards of Rule 4.09.1. Please revise the PAP to address these <br />requirements. <br />Response - Rule 4.09.1 pertains to the disposal of excess spoil. All excavated non-coal <br />material from the mining areas will be used for backfilling the mined pits and blending <br />mined areas into the existing topography to achieve the approximate original landform. <br />Therefore, no excess spoil material will exist. However, WFC will abide by applicable <br />rules pertaining to the temporary overburden stockpile. The estimated overburden <br />stockpile volume is 900,000 bank cubic yards. <br />3. Subsection 2.05.3(6)(a) Overburden Blasting has been provided with the application. The <br />Division has no comments regarding this section at this time. <br />4. Rule 4.08.2(1) requires that owners of structures within'/2 mine of the permit area <br />(emphasis added) be notified.
