part of the review and approval process for PR-2, MCM will work directly with the SEO to <br />obtain permits for the on-site monitoring wells that they intend to keep operational. Wells <br />that will not be retained for the groundwater monitoring program will be properly plugged <br />and abandoned. <br />• Construction and operation activities will not affect the flow in McClane Creek or any <br />stream or ditch. <br />The SEO previously submitted these same four items of concern to the Division in a letter dated <br />December 10, 2010 following their review of the Permit Revision No. 2 application. These were <br />forwarded to MCM in our adequacy letter for PR-2 dated February 15, 2011. MCM will be <br />required to again adequately address each of these items as they relate to the permit revision <br />application prior to Division approval of PR-2. Permit Revision No. 2 was received by the <br />Division on November 1, 2010. This permit revision is to provide for expansion of surface <br />facilities and expansion of the mine. With this revision, MCM proposes to significantly change <br />both the mine plan and reclamation plan. MCM has not yet responded to our February 15, 2011 <br />adequacy review of the permit revision application. The permit revision is pending further review <br />and approval by the Division. <br />The cost estimate for bond liability has not been revised as a result of the renewal application RN- <br />07. The latest reclamation cost estimate prepared for Minor Revision No. 49 of October 4, 2010 <br />remains in effect. The calculated liability for the McClane Canyon Mine is $390,995.00. The <br />Division currently holds a surety bond in the amount of $390,995.00. <br />The McClane Canyon Mine is in temporary cessation and will likely remain inactive until approval <br />of PR-2. The reclamation cost estimate will be evaluated with regard to the permit revision. A <br />new cost estimate for bond liability will be prepared by the Division to include changes to the mine <br />plan and reclamation plan resulting for Permit revision No. 2. <br />MCM published public notice of its application for permit renewal in the Grand Junction Daily <br />Sentinel once a week for four consecutive weeks beginning December 28, 2010. Proof of <br />publication was provided to the Division on January 24, 2011. There were no comments regarding <br />this permit renewal received by the Division as a result of the public notice. <br />The Applicant Violator System (AVS) was queried on March 15, 2011 and again on May 31, <br />2011. There were no violations listed and the Division recommends an "issue" for the permit <br />renewal. <br />Publication of this RN-07 proposed decision by the Division will initiate a thirty (30) day public <br />comment period, after which the renewal decision will become final, provided there are no <br />objections. <br />Description of the Environment <br />The McClane Canyon Mine is located approximately 20 miles north of Loma, Colorado, at an <br />elevation of approximately 5,800 feet. Land use within the permit and adjacent areas is rangeland <br />supporting both livestock grazing (cattle) and wildlife habitat. There is some irrigated agriculture
