3) to transfer the permit from LEI to CAM. The transfer was delayed due to delinquent federal <br />lease royalty payments owed to BLM by LEI. These issues were resolved, and BLM approved <br />assignment of the federal coal leases on 11/4/04 (effective 12/1/04). The Division issued a <br />proposed decision approving the permit transfer to CAM on November 17, 2004. The transfer <br />decision was final on December 17, 2004. <br />On February 14, 2005, the Division approved a permit renewal (RN-05) for a new permit term <br />expiring July 6, 2006. On March 30, 2007 the Division received an application for Succession of <br />Operators (SO-4) to transfer the permit from CAM to McClane Canyon Mining, LLC (MCM). The <br />Division issued a proposed decision approving the permit transfer to MCM on May 3, 2007. The <br />transfer decision was final on June 2, 2007. <br />On January 12, 2007 the Division approved a permit renewal (RN-06) for a new permit term <br />expiring July 6, 2011. Since the permit renewal issuance date of January 12, 2007 there have been <br />no Notices of Violation issued. <br />The operation is in compliance with the terms and conditions of the approved permit. Permitting <br />actions since the RN-06 approval are described below. <br />Summarv of Permittinja Actions <br />Permitting actions processed subsequent to the April 1, 2009 mid-term review document are <br />summarized briefly below, in chronological order: <br />MR-47 proposed approval decision was issued October 20, 2009. The revision allowed for MCM <br />to export coal mine waste to Snowcap Coal Company's approved coal mine waste disposal area at <br />the Roadside Portals Mine (CRDA-1). The coal mine waste came from the Operators sediment <br />drying area which was nearly at full capacity. <br />MR-48 proposed approval decision was issued June 22, 2010. The revision allowed MCM to <br />install short poles to support an existing fiber optic cable. The poles and fiber optic cable will <br />extend from the office area to the portal area. The poles will be approximately 15 feet tall. The <br />poles have not yet been installed at the site. <br />MR-49 proposed approval decision was issued October 6, 2010. This minor revision allowed <br />MCM to increase the size of the shop on the portal bench. This expansion has been completed and <br />will allow the operator to more efficiently work on equipment during winter months. <br />Permit Revision Application No. 2 (PR-2) was received by the Division- on November 1, 2010 to <br />provide for expansion of surface facilities and the mining plan. The proposed revision PR-2 would <br />provide for new coal cleaning facilities, a new coal mine waste pile, sediment pond and topsoil and <br />construction material stockpiles south of the existing McClane Canyon Mine facilities. The <br />Division sent a preliminary adequacy review letter to MCM on February 15, 2011 and has not <br />received responses back from MCM. This revision would substantially increase the reclamation <br />bond liability and a new reclamation estimate would be prepared of the revision if approved. <br />4
