Permit No. C-1981-008 <br />Bond Release Application SL-12 <br />May 31, 2011 <br />pasture reclaimed area and reference areas. The following comments address the numerical sequence <br />from the Division's May 16 letter. <br />The source of water for both the reclaimed area and the reference area was from the CCC ditch. <br />Response accepted. <br />The Division asked what date water was released in the reference area and the date water was <br />released in the reclaimed area. The May 23 response gives the dates water was released and <br />ceased in 2007 and 2008 from the CCC ditch, but the dates the water was released and ceased <br />on the reclaimed area and the reference area is not provided. The permit requires WFC to apply <br />the water to the reclaimed area and the reference area at the same time. <br />The irrigation application rate for the reference area and the reclaimed area were provided, <br />however they were provided in different units for each area. Ten shares of water were used to <br />flood irrigate the reference area as approved in the permit. According to the permit this rate <br />equals 1.64 shares per acre. For the reclaimed irrigated pasture, the rate of irrigation reported <br />in the amended SL-12 application was 2.5 ac-ft/acre in 2007 and 2.4 ac-ft/acre in 2008. The <br />same irrigation unit rates for both the reference area and for the reclaimed area are needed so <br />the rates can be compared. <br />4. Based on the narrative in the May 23, 2011 submittal, it seems the reclaimed area and the <br />reference area were managed solely for livestock grazing. If this is indeed the case the following <br />conditions apply from the approved permit for livestock grazing (page 2.05.4(2)(e)-19D). <br />Livestock grazing. "The reference area will be grazed by cows in late <br />June, after any vegetation studies are completed. The livestock will be removed <br />by the end of June, and the reference area will not be further grazed by <br />livestock during the growing season. The reclaimed area will be hayed in late <br />June after any vegetation studies are completed. Winter grazing by cows, deer <br />and elk occur on all areas." <br />In the amended application, the first sentence of the section Grazing During 2007 and 2008 <br />Study Years is not clear. The sentence says, "Beginning in 2007, the contract farmer grazed <br />both the reclamation areas and the reference area to stubble each year, unless instructed not <br />to." Please explain why the clause, 'unless instructed not to' is included. <br />Based on the subsequent narrative the reclaimed area was grazed by roughly 35 head of cattle <br />on the irrigated pasture north of 5th Road and south of BB Road. The reclaimed pasture is larger <br />than the Phase III requested parcels. The acreage for the entire pasture is needed so that the <br />average number of animals per acre can be calculated. <br />The amended narrative claims both the reclaimed and reference areas were grazed to a stubble. <br />The term stubble is open to interpretation, please describe the term as it is used in the amended <br />appiication. <br />
