Mining & Safety <br />On behalf of AGC Resources, LLC ("AGC"), I herein provide the following summary discussion <br />(with appropriate attachments, where cited) relative to four (4) outstanding corrective action <br />items associated with the Cash and Who Do Mines (Permit No. M 1983-141). These corrective <br />action items evolve from the sequence of correspondence that includes the Division's initial <br />letter of January 12, 2011; AGC's response and request for extension letter of February 15, <br />2011; and, the Division's March 9, 2011 status confirmation letter. <br />The status of each item is as follows: <br />RE: JUNE 12, 2009 INSPECTION (PRE-AGC) CORRECTIVE ACTION ITEMS <br />Compliance Problem 1: The Escape-Way Shaft Has Not Been Approved as Part of the <br />Reclamation Plan. AGC proposes to close the escape-way shaft by installing a nominal 6-inch <br />thick reinforced concrete slab immediately atop existing I-beams that are notched into and set <br />on competent rock at an estimated depth of 6-feet below grade. A 3-inch I.D. vertical steel pipe <br />(capped) or equivalent will be set in the concrete and extend to a nominal 12-inches above <br />grade at the surface (as a locating monument). The void area will be backfilled with locally <br />available waste rock and fines to grade, and the resultant surface area will be revegetated in <br />accordance with the DRMS previously approved seed mixture for the Cash and Who Do Mines <br />permit area. Closure activities are currently scheduled for the month of July 2011. <br />This is a minor modification of the Inactive Mine Reclamation Program Standard Drawing No. 2, <br />with the variance being elimination of the hollow-core or conduit component, as there is no need <br />to facilitate future access to the shaft (raise). The DRMS-authorized extended corrective action <br />date of August 31, 2011 is duly noted. <br />Compliance Problem 2: Incorrect Financial Warranty Bond Form on File. AGC submitted <br />the proper joint agency (DRMS and BLM) financial warranty form to the Division in early March. <br />In a letter of March 16, 2011 (to AGC) it was indicated by the Division that the form had been <br />received/accepted and that transfer and/or restructuring of the existing financial warranty to that <br />Y T Y1
