Exhibit M Additional Info <br />Discharge Permit <br />SME has written a Stormwater Management Plan (SWMP) for the project site and has <br />submitted an application to the CDPHE for a water quality permit for "Process Water and <br />Stormwater Discharges Associated With Sand and Gravel Production Operations (and Other <br />Nonmetallic Minerals Except Fuel)". No discharge will occur without approval from the <br />CDPHE. A copy of the permit is included for your reference. <br />Water Rights <br />The proposed project has carefully considered the impacts to vested water rights. The Keyah <br />Grande Ranch has an augmentation plan currently pending with the State Engineer. Please <br />note that upon reclamation, the total wetland area will very close to the quantity of wetland <br />area that existed prior to site disturbance, which means that any net increase in <br />evapotranspiration as a result of the project will be accommodated by the augmentation plan. <br />No work will commence until the augmentation plan has been approved by the Office of the <br />State Engineer.
