Pineda <br />Director <br />From: Brock Bowles <br />RE: New Horizon Mine (Permit No. C-1981-008) <br />2008 Annual Reclamation Report Review (revision) <br />Pursuant to your request, I have reviewed the 2008 Annual Reclamation Report revisions submitted by <br />Western Fuels Colorado for the New Horizon Mine. Most of the comments from the previous review <br />were addressed adequately. However, one mapping item remains unresolved: <br />1. Exhibit 2008-6, 2008 Topsoil Sample Points - It is unclear the topsoiling sequence east of <br />the 1996 topsoiled area. <br />a. The area topsoiled in 1996 is labeled on the map as 25.79 acres and 22.75 acres. <br />Please clarify the proper acreage. <br />b. Please clarify when the 39.45 acres of the Ron Ebberts- Phase IV area was <br />topsoiled. The nomenclature of this area is different than the other topsoiled areas <br />and therefore, it is suggested to incorporate this area into the 1994 or 1995 topsoil <br />years for clarification. <br />c. Exhibit 98.5 (attached) has the topsoiled acreage mapped much clearer in the years <br />1994-1998.
