CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations. If stormwater is contained on-site, it must
infiltrate into the ground or be released to the natural stream system within 72 hours, or all work
must cease until a substitute water supply plan, or augmentation plan approved by water court, is
obtained. Reclamation plans must ensure water will not be retained onsite for more than 72 hours
unless an augmentation plan approved by water court is obtained.

® Other: The water consumed by this operation is leased from the Board of Water Works of Pueblo
and shall be subject to the conditions set forth in the Division 2 Engineer's April 11, 2011
administrative exchange approval letter.
COMMENTS: According to the-application materials, this is a dry mine operation and ground water will
not be exposed. Consumptive use of water will occur during sluicing and as dust suppression on the haul
road, stockpiles, and working face, and such water will be leased by the applicant from the Board of Water
Works of Pueblo. An administrative exchange was approved by the Division 2 Engineer, Steven J. Witte, on
April 11, 2011, which allows for the diversion and consumption of a leased water supply (from the Board of
Water Works of Pueblo) of up to 60 acre-feet from April 1, 2011 - October 31, 2011, with water depletions
estimated to be no more than 15 acre-feet.
