KAY E•3t.ECNA - MOUNT ELBERT MINING COMPANY <br />Dear Mr. Blecha: <br />We have reviewed your April 6, 2010 application on behalf of the MouNT ELBERT MINING COMPANY <br />for approval of an administrative exchange from Twin Lakes Reservoir and portions of the <br />Arkansas River up to the headgate of the your mining operations on Corske Creek located <br />approximately in Section 4 of Township 11S, Range 80W, Sixth P.M. <br />Your letter seeks approval for an administrative exchange for up to 60 acre-feet of consumable <br />water supplied under a lease from the Board of Water Works of Pueblo. <br />This source is proposed to be used by direct flow through your ditch and pond system for <br />mining purposes. Permission from the City of Aurora who apparently owns the neighboring <br />property through which a portion of this old placer ditch system passes has previously been <br />obtained by you and was verbally confirmed with the city by this office on April 12, 2010. No <br />known water rights exist on the proposed exchange reach of Corske Creek. <br />Your proposed operations involve water usage consisting of the filling of five sealed recirculating <br />ponds (10.2 acre-feet total), evaporation from these ponds, and operational losses. Water <br />depletions from this operation are estimated to be no more than 15 acre-feet. <br />Approval of this exchange is subject to the following conditions: <br />• Diversion and consumption of thjs leased water supply is limited to 60 acre-feet <br />from April 1 through October 31, 2010. <br />• Revocation upon a finding of injury to vested water rights.
