Pineda <br />Director <br />The Division of Reclamation Mining, and Safety (Division) has reviewed the above referenced <br />technical revision application materials submitted to gain approval from the Division to remove Ponds <br />8 and 9 at the South Portal and Pond 7 and other drainage control features at the North Decline. The <br />Division has the following adequacy review comment that is applicable to both the South Portal and <br />North Decline areas. <br />1. Snowcap Coal Company (SCC) has demonstrated that the untreated drainage from the South <br />Portal (Roadside Refuse Disposal and Borrow Areas) and from the North Decline disturbed <br />areas will contribute fewer suspended solids to streamflow or runoff outside the permit area <br />than untreated drainage from the natural surrounding premining area. This was accomplished <br />by a soils loss comparison between these disturbed locations and corresponding non - disturbed <br />reference areas using the Universal Soil Loss Equation. However, SCC must also provide a <br />demonstration that the quality of untreated drainage from these disturbed areas meets the State <br />and Federal water quality standard requirements applicable after the sedimentation ponds and <br />treatment facilities are removed, if any, for receiving streams. To fully comply with the <br />requirements of 4.05.2(2) please provide an appropriate water quality demonstration that the <br />untreated drainage from both the South Portal and North Decline areas meets the applicable <br />State and Federal water quality standard requirements after the treatment facilities are removed. <br />If you have questions or need additional information, please contact xne. <br />Sincerely, <br />Ok P.
