clearWATERsolutions <br />water rights • planning • engineering <br />April 26, 2011 <br />Ms. loana Comaniciu <br />Division of Water Resources <br />1313 Sherman Street, Room 818 <br />Denver, CO 80203 <br />RE: Long-Term Depletions from Weld County's Geisert Pit, M-78-210 <br />Dear loana: <br />The purpose of this letter is to provide your office and the Colorado Division of Reclamation, <br />Mining and Safety (DRMS) information to demonstrate that Weld County can replace long-term <br />injurious stream depletions that are a result of mining related exposure of groundwater at Weld <br />County's Geisert Pit. In accordance with the April 30, 2010 letter from the DRMS, all sand and <br />gravel mining operators must comply with the requirements of the Colorado Reclamation Act <br />and the Mineral Rules and Regulation for the protection of water resources. The DRMS letter <br />identifies four approaches to satisfy this requirement. <br />The County does not have a bond to cover the cost of installing a clay liner or slurry wall due to <br />the fact that financial warranty through bonding is not required for a county. However, the <br />County intends to construct a slurry wall as outlined in the attached DRMS Mining Permit <br />amended Exhibit E (reclamation plan). Additionally, as outlined in the amendment to the SWSP <br />plan (submitted to your office via e-mail 4-6-2011), Weld County anticipates beginning <br />construction of a slurry wall at the Geisert Pit site this summer (2011). Per discussions with <br />DRMS staff, this satisfies approach number 3 outlined in the April 30, 2010 DRMS letter. <br />Cordially, <br />Clear Water Solutions, Inc. <br /> <br />Michelle L.
